I recently took out a few internet payday loans not knowing that they were illegal in my state of PA. Anyways, I did everything that I was suppose to...filed with Department of Banking, BBB, closed my account.

I just recently received a telephone call from an attorney stating that she is suing me in my county (which she gave to me was correct) for a bad check! I am completely at lost because I told her on the phone that internet payday lending is illegal in my state because of the interest percentage. She told me that I had a binding contract.

Would anyone be able to help me figure out what to do about this so called email that I am getting? Thanks


If payday loans are illegal in your state, then neither the payday lender nor the attorney will be able to take any legal actions against you. In my opinion, they are simply trying to scare you so that you start making the payments. I will suggest you to not make any payments to them. If you wish, you can even contact the county records to find out if they have really filed any case against you.

Payday loans are illegal across a majority of states. Such contracts can't be termed as "legal" or "binding" since these loans are illegal in the first place. Don't allow yourself to be intimidated by them. As they don't have the license to issue such loans, they won't be able to sue you. The absence of any jurisdiction or authority will prevent them from doing so.

also a "bad check"is a crime and they can't do that because an ACH is not a check.btw not only are pdl's prohibited in PA,but PA is non-garnishment.so the pig basically broke the law with the threat.so file a police report for the call,remember that number and ignore it as again an illegal threat that should be treated as such.

well here is how i would respond as this is just another piece of crap humanoid collector that needs to try and bully/scare people.respond this way.

well since pdl's especially this one are illegal in PA i don't owe 870.00.in fact the actual amount if any is up for debate.btw i know enough to know nothing reall was ever done via email,but will forward this to the PA AG,AND NY AG as part of a complaint against not only cash yes,but your wonderful place.since after the illegal phone threats this email gets sent i suspect it was you calling so any further emails will also be forwarded.unless you actually want to send a letter and not an email.until then i will not call,or rspond to further emails just forward them. sincerely.

anyway that is how i would respond.they are not gona do squat.as i stated in my mock response nothing was ever done via email in that sense,and no court in PA will rule for an illegal lender.

I got a call from them too. I am in NC - PDL are illegal here too. They claim they have sent me two letters and an email. Not true. When I sign on to the CashYes website it welcomes me back and tells me to fill out another form to get another loan. I actually paid them more than the total amount of the loan. I guess I will file yet another complaint with the NC AG office.

I was curious when these pdls say you wrote a bad check how do they come to that conclussion? because we closed out our checking accounts and they cant take out money, they consider it a bad check?
