3rd party collections on payday loan threaten me

Hello, I have a similar situation as another individual on this site; I borrowed money through Cashnet USA a few years ago; was laid off and have not paid the money back even since I started working again. I would like to pay it back if I could divide amount. The 3rd party agency that is calling me states that I owe $925, which is $425 more than I initially borrowed. They have threatened that they are filing criminal/felony check fraud charges against me today if I did not pay that money back within the next two hours. When I inquired of who to call back once I see if I can come up with that, the woman responded that "I have no time to play games, you need to tell me right now, or we're filing the charges against you in 30 minutes. The agency calling me, according to the caller, is Check Investigative Services. This is unnerving to say the least, but I could clearly pick up on her harassing tactics. Can you comment on whether or not, not giving me a chance to respond, or break the pymt up or threaten to file criminal charges on me is even legitimate? Thanks so much for your time. DD


This sounds like a scam. If they call again tell them that according to the Federal Debt Collection Practices Act they have to send you something in writing within 5 days of their initial contact. That if they do not send something in writing you will assume they are operating illegally and will file complaints with the AG and FTC.

Try to get an address from them and send them a DV letter. I think this is a scam!

You can request the DV, but more importantly, the minute they say that they are going to have you arrested is a BIG red flag!!! A collector can NOT have you arrested for this regardless of what they may think and by sayinng that, they have told you that you do not want to deal with them. Call CashNetUSA and report the situation to them and all authorities.

Whatever you do, DO NOT send this CA a penny.
