I got a phone call from a law office tidy stating that Payday Max is going to serve me at my place of work. I have until noon tomorrow to inform them of what I want to do. It's from 2008 from Payday Max America. The face value is 1000 dollars which includes interest. They will not provide me with the original loan documents or amount and I have no idea what it is. I am in Michigan. What are my rights????


This is a scam. The next time they call, tell them you are aware this is a scam and unless they intend to send you something in writing, they can FOAD. They will NOT come to your place of employment. They are trying to scare you into giving them money. File a police report and give them the phone number and any other info of the people who are calling you. Do NOT give them any info about yourself or confirm or deny (verify) any info they may already have. Hang up on them when they call.

I did verify information but not the debt itself.
What do I tell them to let them know they are illegal? I don't even know if the collection agency is legal. Can I ask them to provide written documentation for the validity of the debt plus their status as a collection agency? Does email count as written documentation? Do they have to LEGALLY provide me with the original documents (she told me I should have printed them out) including the original amount? Can they serve me anywhere? They have my mom's address and contacted my former employer. If a server shows up, I'll just die. I would pay the principal since I'm sure they are illegal.

Again, they aren't going to serve you. This is a very common scare tactic with collectors for PDLs. Yes, you tell them to send you something in writing and if they won't, that's a BIG clue that they aren't legal. After you tell them once to send you something in writing, don't talk to them again. What state do you live in? How much did you pay before you defaulted? Paydaymax isn't licensed to lend in the U.S. that I'm aware of so, the loan was illegal to begin with. By the way, it's highly unlikely this is even a "law office" calling you. It's a bottom-feeding, illegally operating collection agency :)

I have no idea what I paid or what the original loan amount was. I am in Michigan. Shoul I call, get an address andsend a certified letter asking for debt validation?

Yesterday I found out that this Davis and Clark company called my mom and my sister's father in law (random). I did some research and apparently, collectors are not allowed to call others more than once. Is this true? Also - I read there is an FBI investigation into this company. Their website is www.davisclarkinc.com. It's completely generic with no info on the "lawyers" that work there.
I called Diana Scholz this morning who is a "paralegal" there. I asked for the companys address and told her I hav rights. The right to receive written documentation regarding the original loan as well as the address of the alleged debtee (is that a word?). She told me she doesn't have the information and when I said what kind of an agency doesn't have the address she got all defensive. She said she emailed me a letter with the info which I never got. I told her I researched Payday Max and they are illegal. She said so you did receive funds and I said I do not admit to that, I researhed because you are alleging I owe. In the end she said "who are you? You're a debtor, pay your bills. You are wasting my time" and hung up. What do yo think will happen now??

As I said before, you need to stop talking to them. No, you shouldn't send a DV letter. What's the point? They haven't even sent a Dunning letter. You should file complaints, as I stated previously and STOP communicating with them. They will NEVER leave you alone as long as you continue to pick up that phone.

ohiogal is right.stop talking to them.if the number looks unfamiliar don't answer.let it go to v-mail.if you gat caught on the phone hang up without a word.file the complaints,and do not talk to these idiots further.a waste of your time.

OMG. I thought i was the only one that was having that problem, But just as the others have told you don't worry about it. I paid them off so i know i don't owe anything, but ever few months they call again. I always tell them to do what they have to do and i also ask them what loan company its for they never have an answer and i don't give them any information. I hang up and they try again. Don't let it bother you and don't give out any of your information.
