dispute with OC or validate with CA first
Date: Sat, 06/04/2011 - 18:25
The combined total is aprox $25k. They've been sold to CA's now. I realize I can request to validate with CA and dispute charge off with the OC but does it matter which I start with or if I send letters to both at the same time? My plan is to make the request via certified mail directly to the OC and CA, THEN I can request any changes be made with the bureaus after 30 days correct?
Does anyone know if OC typically challenge chargeoff and fact disputes after 4 years?
I would like to get info from one of them for last activity since the CA that has the account appears to reaging the debt as if I made a payment on it Dec of 2010 and one has a limit of 9500 but says balance owed is 11000.
Thanks in advance for any advice on the best order to proceed and sharing any experiences with chargoffs.

If the debts has been charged off, then it will be better if you could contact the CA and ask them to validate the debt. The OC won't be of any help in this case. I don't think the OC will challenge the dispute in any way.

I'm unclear as to what you're trying to accomplish? Are both the CA and the OC reporting? Are you trying to get one or both of those removed? Are you disputing the accuracy?

Thank you #2,
Ohio, The original creditors and the collection agency are both listed on my report. Its my understanding they can do this since the OC has it marked as closed. But I'm hoping the debts are so old they won't bother to dispute or verify accuracy and will be removed from my report or atleast if they do still have the records I will have the principal amount and last activity with them in order to negotiate with the CA that owns the account now.
I think there are two CA listed for the same account with one of them being listed as closed. So my objective is to 1) validate that CA owns the account, has the right to collect on it, arent reaging the debt and are the ones I should negotiate any settlement with and 2) removing any negatives possible such as the OC and duplicate CA that have been sold.

Negative items will remain on your credit report for at least 7-10 years. If you want to remove those negative listings from your credit report, you need to payoff your debt. You may contact with your OC and request them for a settlement. If they???re agree with your proposal, then payoff the debt as per settlement. After that, you can request to your OC to remove the negative listings from your credit report and update your account status as ???Settled Charge off???. You may send a written request for validation letter to the CA. If the OC refuses to settle the debt with you, then you can negotiate with the CA who holds your current account and settle the debt.

Thanks, that helped.
I suggest you dispute and request validation of the debt, directly to the CAs first. If you hear nothing from them in 30 days after you've sent your dispute, then send copies of your dispute letters to each of the 3 bureaus. With no response, they should be removed.
After the CAs are removed, try sending a goodwill letter to the OC asking them to remove the tradeline.
