NC Payday Loan Help
Date: Wed, 06/08/2011 - 21:04
State: NC
Loans:
US Fast Cash - Borrowed $300, Paid $90, Owe $210
One Click Cash - Borrowed $300, Paid $640, Overpaid $340
Ameriloan - Borrowed $300, Paid $90, Owe $210
Cash Call - Borrowed $1500, Paid $722.80, Owe $777.20
(This loan was originally with Western Sky and was sold to Cash Call)
Plain Green - Borrowed $800, Paid $240.20, Owe $559.80
I also had a loan with Think Cash which was paid off. That loan was for $600.00. I paid $896.80 so I overpaid by $296.80. I got another loan but Think Cash was bought by Plain Green.
I found this site after I realized that I could not handle all of the payments anymore. I was looking for a way to consolidate the payments and came upon this site where I found out that the loans are illegal. So I closed my bank account and changed banks. I emailed letters to the companies on 6/5/11 and asked for a response within 5 days. I did a "nice" version of the sample letter stating that I was requesting that all communication be done via email, that they should not contact me at my work, nor should they contact my references. I sent the same letter to US Fast Cash, Ameriloan, and One Click Cash as it was clear to me that they are the same company.
Someone from Ameriloan was contacting one of my references, so I decided to give them a call today. I was told that they did not receive my email, that the documents I signed explained that the contract is bound by the OK state laws which is where they are located, and that they would continue to contact my references if they did not receive payment or if there was no contact on my account. They also told me that I owe them $510 and they could set up a payment plan with a debit card. I was also told that Ameriloan is not affiliated with US Fast Cash or One Click Cash.
I also received an email response from Cash Call stating that they would be happy to help me but they need to speak with me in person.
I did not inform any of the companies that I would be filing complaints and I have not yet done so.
Your advice on the next steps for each company would be greatly appreciated.

Payday lending is not allowed in North Carolina. It is considered to be prohibited. Thus, you're liable for paying only the principal balance. You won't be liable for paying any extra fees or interest rates. In order to know how you can deal with the illegal payday lenders, check out the given page: http://www.debtconsolidationcare.com/paydayloan/illegal-pdl-dealings.html .

Payday loans are illegal in North Carilona. You don't have to pay anything other than the principal amount. Don't listen to what they are saying. They'll fabricate things to make money out of you. If you have overpaid on some accounts, then you should ask the lenders to revert the money. Though that chance is remote.
truth about cashcall
yes owner cashcall is not a pdl,but they are running a dodge with western sky.as western sky is tribal they are illegal, and are procurring loans and transfering them to cashcall.cashcall is only allowed to lend in three states.CA,TX,and either UT,OR NM.that's it.it's even on their website, but this is how they are trying to get around that.so the cashcall loan is illegal because it was western sky first, and they are illegal in every state.
New here and desperately need help in NC
I'm in Raleigh, North Carolina and am currently stuck in two payday loans: One with cashyes.com and the other with plaingreenloans.com. I had to get the second one to help pay for the first one and now I'm stuck in a never-ending cycle every paycheck. I had to get the first to help out with my rent due to a recent divorce as well. After reading through some of these threads it appears these loans are operating illegally in NC and they shouldn't have approved me for these if NC General Statute doesn't allow them. Could someone help me figure out exactly what I should be doing to stop this ridiculous amount of money coming out of my account and what steps I need to take to get out of these? I'm pretty desperate right now!
