Last week I rec'd a call from Tracy Smith of Harris and Associates, claiming that I owed them $500 for a payday loan I took out and never re-paid. When I asked for a DV letter, they said they could only send it to my e-mail, not regular mail. When I rec'd the e-mail, it had a word document attached, which gave me an address. I sent them a letter requesting they validate the debt. I sent it Certified, Return, Receipt. Cost me $6.00 at the Post Office.
I just went to the USPS website to track the letter and here's what it showed:

Expected Delivery Date: July 5, 2011
Class: First-Class Mail®
Service(s): Certified Mailâ„¢
Return Receipt
Status: Undeliverable as Addressed
Your item was undeliverable as addressed at 10:34 am on July 05, 2011 in CHARLOTTE, NC 28212. It is being returned if appropriate information is available.
Also note - on 06/30/11, a Deshaun Jackson told me that a process server was on their way to serve me court papers to either my work or home. On 07/06/11, voicemail message from Tracy Smith that a process server was on their way to serve me court papers. I would be served at home or at work, not sure where.
Thanks for letting me post on this forum. The moderators have been a lifesaver to me and with all of their help and wisdom has allowed me to get out of payday loan hell.

You can send them a C&D letter. After that, if they are still trying to contact with you, then you can file a written complaint against them to the State Attorney General or FTC. You may also enclose the copy of debt validation letter with it.

I don't think you will be served with court papers. It is most likely a scam. These bottomfeeders should be taught a lesson...
