Hi. I just rec'd a notice for a summons today from Capital One. (Notice was from sheriff's office so I know it's legit)

I've been reading a lot of information on the web about being sued by Capital One. I am not in a position to make a payment in full to settle the account but could offer a payment arrangement of $400/mth on a $2100 debt.

Is there anything that I can do in court to prevent this from going into a wage garnishment? It is really weird at work right now and I don't want any negative attention.

Does anyone have any experience in working through this on your own or should I hire an attorney? I'm not sure if we have consumer attornies in my area but I could consider consulting a Chapt 13 bankruptcy attorney.

Any advice is appreciated!


Answer the summons and show up in court!

You can go for a contingency judgment.....it allows you to make payments and as long as your payments are made on time, the agency agrees not to garnish or levy your bank account.

Having an attorney represent you in court can be very expensive.....and you can get the same deal representing yourself pro se.
