I took out a PDL and was unable to pay it back. I closed my checking account It went to collections and lawyer called me and told me I was being charged with check fraud. I told her I talked to a bankruptcy lawyer and was told it was not check fraud even if i did close my account. They told me the lawyer that told me that was wrong I tried to work out a payment plan but they were unwilling to accept my payment amount. They called my son today and told him they were going to file charges and I would be charged with checkfraud and a warrent would be issued if I did not show up in court. Now they are saying if I pay 125 and then 50 a month they won't charge me. i Live in minnesota is any of this true


As payday lending is legal in Minnesota, I will suggest you to contact the Minnesota Department of Commerce and check out if your payday lender is licensed to operate in your state. If they are not licensed, then they won't be able to take any legal actions against you. You can simply pay them the principal amount and get rid of the debt.

I think Anna is right. If the lender is not licensed to operate in your state, then you are required to pay only the principal amount. Illegal payday lenders don???t have any right to take any legal action against you. To know more about illegal payday lenders, glance through the following link:
