here is what you do
you first check your court clerk's website as they would have any case.you can type your name as the defendent to see.this place must sue in your town,county,village,bourough.to sandy quit giving bad info as lawyers don't just give away their services,and the OP doesn't even know if there even is a lawsuit.geez.

Thank you for saying that to Sandy, Paul. I get so tired of some always saying-take advice from a lawyer they can help you. Yeah, everyone knows that already, but if they are coming to these forums they need help and odds are they can not AFFORD an attorney. So, always being told to "seek advice from an attorney" sounds condescending sometimes to those who come here seeking help because they can NOT afford one.

Being sued
The attorney that sent you the letter went to the county clerk's web site found your case and is trying to get your business. Just call the clerk's office in the county in which you live give her your name and ask her if you are being sued it is as simple as that she will tell you. She will also tell you if the citation has been issued or is pending. Micheal J. has two choices he can send it by way of process server or by registered return receipt mail he prefers registered mail its less money out of his pocket. do not admit to anything and when you get the citation answer it do not let him get a default judgment. Hi again,
I checked the HC website but did not find anything. BUY then I went to the Justice of the Peace Courts in Harris County and was able to find a suit that was filed but it was filed in the wrong Precinct. I still have not been served. Any advice.

It actually may be another few weeks before you receive a summons, so there may be time to attempt to work something out with Michael J. Scott's office.
Is there a family member or friend who may be able to loan you portion of this debt, so you can offer the law firm a settlement? If not, and you can't afford an attorney, you'll probably just have to wait until you receive the summons. After this takes place, you'll want to file an answer, but I suggest waiting until near the deadline to file, as this will give you some time to accumulate at least a little something to offer your creditor. If the account is not resolved by the time a court date arrives, they may get a judgment against you. If this occurs, you can request payment arrangements, which will have to be approved by the court. In your case, this is a small account, and it sounds like you're struggling. If you get a decent judge he may even allow payments as low as $25.00 per month.

First of all, just wait until you have been served. You don't need an attorney in a justice/small claims court. Usually these types of lawsuits are filed YEARS after the debt and after 3 or 4 collection agencies have had the account. IF THEY CANNOT PROVE UP EVIDENCE, SUCH AS SIGNED RECEIPTS, WHERE YOU PURCHASED SOMETHING, THEY CANNOT PROVE THE DEBT. In other words, if they say you owe $1500, they must show every receipt that equals $1500.00 If they cannot, the court must dismiss.
