So I finally received DV letter from Smith, Haynes & Watson claiming that I owe LoanPointUSA $1104.60 for a $500 loan that I paid $1656 for! OMG. I hate these people so much. :(

Anyway, the letter looks pretty legit...I need to hear confirmation from you guys that LoanPointUSA IS ILLEGAL in the state of Texas because they do not have a license to lend to residents in the state of Texas...is this correct? Can someone assist me in writing a letter back to them stating that their client is illegal and that their client OWES ME A FREAKING REFUND?? :( Yes, i am aggravated...

Here is the letter:
Dear JK:

You previously made arrangements to satisfy your financial obligation to Loan Point USA.com. However, you failed to fulfill your commitment and those terms are now null and void.

Loan Point USA.com has employed SHW, LLC to recover the outstanding amount owed to them on the above referenced account. Our Client has indicated to us that this debt is just and legitimate, and is therefore approaching this matter with utmost seriousness.

This letter is designed to afford you the opportunity to resolve your obligation without the need for us to pursue further collection activity.

We would prefer to work with you to resolve this matter. Therefore, we propose you take advantage of this opportunity and return the below notice with full payment.

You can also visit us online at www.paysmithhaynes.com . If you have any questions or need to make alternative payment arrangements, you may contact our office at the above referenced number.

I have received phone calls from Smith, Hayes, and Watson but never any letters. WHen they called, I would ask them to send a letter but they never would. They were trying to collect on two payday loans I had. I told them without sending me a letter first, I wouldn't pay because I do not know what they were collecting for. Plus in Texas, collection agencies must be bonded to collect from state residents. Last time I researched I couldn't find any bonding information.

what SHW sent was not validation.SHW is as much of an illegal entity in TX as loanpoint which is neither is legit,or legal in TX.if you haven't filed AG,AND FTC complaints against both loanpoint and SHW.just know you overpaid and loanpoint owes you.SHW is not going to take you to court,and this letter should be part of your AG complaint.just file the complaints and ignore further communication as again both parties are not legal in TX.

So don't send them anything at all? Not even a C&D letter to stop calls (and perhaps add more to file with the Attorney General's Office, FTC, etc)? I guess I am just nervous about not responding at all...and I wonder if it would hurt to at least just send a C&D and tell them to ***** off. LOL.

of course you can send a C&D,but i guarantee you they won't abide by it.just know that.send the letter,but file all the complaints as well too.
