This guy called my phone today, left me a message telling me his is Brad Sanders, (real mean) then he called my daughters house, left a very threatening message. I have NO idea how this man got my daughters phobe number, her name is even different. She is very upset with me, she doesn't like phone calls to her house from any debt collector. He said he had a claim against me, and that he wanted me to call this number 855-502-7963 it say's the company's name is : Recovery Processing Systems, then another person called my phone from a number by 855-666-1469 and they say their name is AG something..and if I got a claim letter from the court I am to push 1. He said he was going to come to my house or my place of work and serve me, can he do this. Can he find my daughters house since he has her number I am scared shitless can anyone give me an answer out there. I am not working right now, as I got laid off and have no job.

Hi!
Welcome to the Forums!

The debt collectors can't threaten consumers while collecting debts. If the collectors threaten your daughter again, then she can file a complaint against the CA to FTC.

Next time, when you get calls from the collection agencies, you should ask for their addresses. Send a debt validation letter in writing to both the CAs. If they don't validate the debt, then send a Cease and Desist letter via certified mail to them.

This may be a scam. I don't feel they are going to sue you. But if you really owe the debt, then it is better to settle the debt.

Hi scooper,

Welcome to the forums :)

???He said he was going to come to my house or my place of work and serve me, can he do this.??? Yes, he can come to your house and serve you. As for the office thing, in most of the cases they just threaten to serve you at office and may not even do that. But, it may not be an illegal thing to serve you at office; though I am not sure.

But try to find out if you owe any such debt and for that you will have to check your credit reports. If you think that you owe any such debt, it is better to work out a repayment plan with the debt collector as per your affordability. You can even try validating the debt. This will put a stop to their attempt to sue you. Until they are able to validate the debt, they won???t be able to sue you.

Thanks,

Marvel Becks

first off the humanoid broke the law in at least two ways.

1)the call to your daughter.he is only supposed to call to get your contact info, nothing else.by stating there was a claim against you is illegal.
2)the threat of service.proceess servers,or collectors don't call ahead.this idiot is using"scare tactics.

here is what you do.file a police report as again the first call was illegal, and the threats were illegal.use the names, and phone number to do this.then use that info to file a complaint with your AG.have your daughter do the same.i guarantee you will not be served so file the report, and complaints then ignore the SOB because he is a lawbreaking scammer.

If the call you received was from a bill collector (and, based on the fact that he was rude, I believe it was), he definitely violated the Fair Debt Collection Practices Act (FDCPA). You see, bill collectors are prohibited from threatening to sue you - unless they actually intend to do so. And, since Recovery Processing Systems is not a law firm it would be impossible for them to file suit against you.

On the other hand, if Recovery Process Systems happens to be a process server (again, I don't believe this is the case), they can definitely serve a summons at your home.

I suggest contacting your creditors to see exactly where each of your accounts is so that you can be certain that you are not facing a lawsuit. This will put your mind at ease a great deal. Also, please access the link I included so that you'll be armed with all the necessary information you need to battle these bill collectors in the future.

I wish you the best.

if after what i posted the OP has any doubts about this being a scam.they can check their court clerk's website.they can type their name as the defendent.btw for being a debt settlement expert you really have no clue.if a creditor filed suit they wouldn't speak to the person.also the threats are illegal.all of them.this is a bottomfeeder that needs to be reported, not paid.

As always, Paul, thanks so much for your kind words!!!

Yes, you can easily access the court system, but if OP has outstanding debt, all of his accounts are not going to have pending lawsuits. It's easier on one's well-being to be informed as to where each of your accounts are so that you can be prepared. I also doubt that the Recovery Processing account will be found in the court system; like I previously posted, I wouldn't be surprised if they are a collection agency.

Yes, reporting this scumbag company is an option, but at the moment I think OP should probably figure out what's going on. After he's well-informed, he can then take the necessary steps to report this place to the AG and FTC.

Have a good day!
