midland funding llc trying to garnish my property

i was sued by midland fundind for a credit card from sears that was over $6,000 that i owed. i didnt kno i was being sued until a couple days before the initial court date. i showed up & asked to have it post poned because i was not informed of being sued properly in the first place. i never got a second court hearing & have now receieved a document stating
"Now comes the garnishee, Branch banking & Trust Co, by its undersigned counsel, and, in answer to the Writ of Garnishment of Property served upon the Garnishee, denies that the Garnishee is indebted to the judgement debtor, Xtina LaLaLa or holds any property of the judgement debtor, and requests that judgement be entered in favor of the Garnishee thereby termionating this garnishment proceeding."
i dont understand what this means. Either way, ive been unemployed since nov 29 2010. i have NO property to my name. im currently staying with my dad, i am currently seperated from my husband. but he & i do have a joint bank account but clearly its just his money. does anyone know what that letter means?
ive tried calling these people but no luck.
can i go to jail if i dont pay this debt back & i have no property they can take from me??????

No you won't go to jail for the debt. Non-payment of debt is a civil offense. As you have no property, so the CA can't impose a lien on your property. Do you receive any unemployment benefits? If yes, then know that the CA can't garnish your unemployment benefits. You can take out your name from the joined account immediately. This way, the creditors will not able to take away your husband's money from the account.
