being sued by midland funding . did not answer summons, as i am not proficient in law studies. know now that i should have. recieved a motion for summary judgement and am now curious to the amount of time that has passed since the loan was aquired. how do i track the loan and how much time has passed. i live in louisiana. and when does the clock start ticking? when midland funding aquired debt? when bank had debt? the balance i have paid on the debt since aquired from day 1 remains 0(zero)

Pull a copy of your credit report from the 3 credit bureaus - TransUnion, Equifax, and Experian. You will get relevant information on this particular debt from there. Are you talking about the Sol clock, then you should know that it starts from the date of first default on the account. Your creditor must have assigned the account to the CA after he has failed get back his money from you.

You should file a motion before the court under their pre-trial discovery process, and request any and all information pertaining to their civil action that is relevant to your defense. Unless the judge considers your request irrelevant to their suit, they will compel the plaintiff to provide it to you. There is nothing better than a court order to get what you need.
If you dont know how to file a pre-trial motion for discovery, it would be worth your while to hire an attorney, at least for that limited action. Not knowing the basis for their action will kill you in court, as you will thus be unable to provide any factual evidence to counter their claims.
