Unemployed and owe debt

Hey there. I'm 24 years old and I owe $1630 to Chase on a 2-3 year old debt (most of this is late fees or fees on not paying on the debt, doesn't matter though).

Was contacted through mail by Midland Credit Management LLC with a invoice/statement/privacy notice, saying that my account is under consideration to be forwarded to an attorney in my state for possible litigation. Am given the option to pay $300 and setup remaining payments. I contacted them to let them know that I'm out of work and have been for a while. I offered to make small payments (around $10 a month, which is probably all I can conjure up). That was denied(not surprised since it's so small of a payment). The statement(2nd paper) states the overall debt/balance owed and says "the balance of $1630 is due by 8/??/2011" (?? is mid-august, I left the day out).

I live with my parents and I'm not currently working. Was wondering how likely it is I could go to court over this? I really don't want to pay any court fees since I can't even pay this as it is. They can't really "take" money from me, since I don't have any, nor any assets other than a computer/printer/car :confused:. This is really frustrating and even more so since I'm ignorant of anything pertaining to this. This is not the only debt I owe by the way :shock: . Just the only agency that has threatened me by saying they might get an attorney.

What part of unemployed with no money do you not understand??? Attorneys cost money and this is hardly a complex situation.

To the OP...have you DV'd Midland to see if they can prove you really owe the debt?? That they actually have the documentation to be able to sucessfully sue you.

I'm pretty sure I really owe the debt judging by everything I have received from other places till now. Whether they have proper rights to it or not, that I don't know, but I'm sure they do.

How would I question that? I don't want to give the implication that since I'm questioning the debt, that I'm thinking I don't owe it. Would that further them to want to take me to court to justify that I owe the debt, that I'm not trying to get out of not paying.

Do I send validation to chase or to midland? Do you have a link to what one should write/request be validated? I myself don't even know what I'm being charged on, just assuming it's late/no payment fees. My credit limit on the card is/was 800$. It's 3-4 years old so doubt I ever went over that limit. Until the fees came where I didn't pay.

Would it also be wise to state my current situation in a validation letter? Reason I haven't been paying or can't pay the requested amount(no job), current living conditions,etc. Since I already gave it to them over the phone and I think that was noted. Seems better in writing.
