Hi there,

I would like to work with Check'n'go to turn over my loan to a payment plan per Ohio Revised Code but they are not willing to work with me.

I guess I am going to have to let this loan default. I just want to pay it off in a way that I am actually paying off the principal.

Will they immediately turn me over to collections?

Will they try to garnish my wages?

Can they do roll overs in Ohio where you only pay finance? I did online but live in OH. I know storefront cannot do this in Ohio.

I'm new to this and got stuck in the payday loan cycle after some hardships happened in my life. I have regular employment and can pay this off no problem--with payments.

I cant help you much with ohio specific law but i stopped paying check n go and..
Once it went to collection,Powell law group started calling my work.
They also sent an email saying i owe 500+ dollars when the loan amount was 230.00.I dont know if they actually follow through with lawsuits or..
If its just an empty threat.

I live in FL and someone used my checking account to get a PDL with American Web Loan, I tried to return the money and they wanted my to pay the loan fee or else they would take legal actions under the bad check law in FL is this possible???? So I close out the account to keep them from trying to take money out of my account every two weeks.

Lending of pdl is considered legal in the state of Florida. You can get information from the Florida Office of Financial Regulation in order to know whether or not pdl companies are licensed to operate in your state. As far as I know American Web Loan is not licensed to operate in your state. That why you are required to pay only the principal amount to get rid of the debts. Illegal payday lenders can???t take any legal action against you. You can ask your bank manager to put a hard debit check on your bank account to stop unauthorized withdrawal. If you have already paid them more than the principal amount, then you can ask them for the refund.

To the OP:

Email CnG's customer service department and ask for an extended payment plan. In OH, they don't have to give you one because of the number of opportunities you have to roll it over (and it's not a PDL, it's a CSO). If they won't give you an EPP, send them a revocation of ACH authorization (email is fine) and let them know you're doing this specifically to force the account to their collections department, with whom you will set up a pay off arrangement.

Did you even read the post you're responding to? The poster said "someone else used his/her checking account to obtain a PDL."


MS LEO,

Closing the account was the right thing to do. And, since this is an illegal lender, you can simply ignore their threats. I would file complaints with the FL AG and the Dept of Banking/Financial Regulation as well.

Do you know who took out the loan and or how they obtained your account information?
