One Click Cash - Complaint Filed

Once I found out that oneclickcash.com was illegal to loan in the state of Alabama, I sent them the c&d letter. After about a week I hadn't heard from them, so I went ahead and filed a complaint with the BBB. I received an email from the BBB stating that the company had replied to the complaint I submitted. Below is their response:

[FONT=Arial]My complaint is One Click Cash is operating illegally by loaning to a citizen in the state of Alabama where they are not licensed and are charging rates and allowing several rollovers that are not allowed even if they were licensed.[/FONT]
[FONT=Arial][FONT=Georgia][SIZE=2][COLOR=red][/COLOR][/SIZE][/FONT][/FONT]
[FONT=Arial][COLOR=red][SIZE=2]In specific, this company is in violation of Ala. Code § 5-18A-1 et seq. which states only one rollover is permitted and the maximum finance rate is 17.50% and the APR cannot exceed 456.25%. [/SIZE][/COLOR][/FONT]

[FONT=Arial][FONT=Georgia][SIZE=2][COLOR=red][/COLOR][/SIZE][/FONT][/FONT]
[FONT=Arial]According to the Alabama Department of Banking, One Click Cash is not licensed to do business in the state of Alabama, which actually makes this whole transaction illegal. [/FONT]

[FONT=Arial][COLOR=red][SIZE=2]All payday loan lenders must have a license to lend in the State of Alabama and must comply with Alabama state laws and regulations. I have confirmed this with my Attorney General's office and the Alabama Department of Banking. Even though One Click Cash is not located in my state, they are still subject to the state laws when they do business here, no matter what the contract says. [/SIZE][/COLOR][/FONT]

[FONT=Arial][COLOR=red][SIZE=2]Here are my specific requests for this company: I revoke authorization for One Click Cash, their affiliates, parent company, or DBA's to withdraw any funds from my checking account. I also revoke any and all voluntary wage assignments I may have signed. This company can only contact me via email. I do not want to be called on my cell phone or work phone. I also do not want them contacting my references. The law states that if I ask not to be called they must abide by it. Of the $400 deposited into my account, I have paid $120 via ACH transaction on 7/5/2011. With that being said, I consider my balance owed to this company to be $280. [/SIZE][/COLOR][/FONT]

[FONT=Arial][COLOR=red][SIZE=2]If the company will provide me with a physical address, I will mail in the remaining balance of $280 in 4 bi-weekly installments of $70 via money order. [/SIZE][/COLOR][/FONT]

SOAPLADY is right in this case.in fact their resonse is a form response as me,and countless others have gotten that from several MTE d/b/a's.like:

get the picture?these are all affiliated and give that same form letter response to the BBB.if you haven't filed an AG complaint do so and forget about the BBB.

I filed complaints with the FTC and my AG office the same day I filed the complaint with the BBB. I haven't heard anything back from either of them. I do plan on paying back oneclickcash the principal, I'm just waiting for them to provide me with a physical address so I can send them the payment.

I agree that the BBB is a waste of time. One Click Cash is a Santee Sioux tribal based PDL. My financial regulator said that they could not do anything about them because they claim tribal sovereignty. I sent them certified illegal lender letters and did research on these so called tribal entity's and found that they were sued in court by a State Attorney's office claiming they were basically just renting space per say from the Indian tribes, and they were not really at all part of the tribe and could not claim immunity from the state laws and the state won. I threw all this info in my letter as well and now my account is marked PIF. Stick to your guns and try other avenues such as your AG, the FCC, and your state regulator. They may be able to help you in your state. Good Luck!

I filed a complaint with the Nebraska Attorney General's office regarding One Click Cash. About 3 days after I filed it, I received an email from OCC, stating they would accept proposal for paying off the remaining balance of the principal. They even accepted the payment arrangements I proposed to them.
