Medical bill summons Michigan w/ incorrect information

I'm such a lucky girl to receive my first summons and complaint for medical bills :rolleyes: I guess they had been searching for me since May (I moved twice since then and had a PO Box).

I was wondering what steps should I take next. At the top of the paper, it states "Summons and Complaint w/ verified account stated complaint" but the financial authorization paperwork is not mine. It is another patient w/ a different doctor. I do not remember anything about the out-patient visit or signing anything that day.

You do not need an attorney. Nelly seems to forget they cost big bucks.

Do you actually owe any medical bills? Keep in mind financial statements are usually signed when you initially visit a doctor, so it might not have been done on the date of a visit. If not, I would respond to the courts denying everything, sending a copy of the other patients documents. Wonders if this is a HIPPA violation.....

Thank you for responding Soaplady. Yes, I do owe for this medical bill (12K) and a few other medical bills (2K) & I am unable to pay for them. I will be calling the attorney's office today but I'm not sure what to say.

At this point, I'm serious considering Ch. 7. I doubt they will take $25 - $30 per month from an unemployed college student. Other then 80K in student loans (which I know I will have to (and want to) pay, I have the 14K in medical bills, a charged off bank credit card of 1K, and a few odds & ends debts from the last 4 or 5 years totaling 2K. I'll have to look it to that today. :(

Ohiogal - Thank you as well for your response. I will file a complaint with OCR but what will happen? Do i have to attend a hearing? I'm wondering what happened to my medical paperwork that should have been attached. Did they send it to another patient?

Wow - what sloppy work they did, including another patient's information. Shame on them.

When you call the attorney's office you'll probably get a representative on the phone, and not the attorney. You can attempt to make affordable payment arrangements, but I'm with you - I don't think they'll accept the arrangements. In the meantime, you can file an answer, as suggested by SoapLady.

I hate to see a college student forced into bankruptcy, but with one pending lawsuit, and a potential judgment lingering, and additional outstanding debt that could bring more lawsuits, you may not have another option. If the debt wasn't so old, you could probably have time to graduate, get a job and start paying, but I'm fearful that you'll start receiving additional summonses. I hope not, but only time will tell.

Best of luck to you - hopefully this will all be behind you sooner rather than later.

It is important to understand the rights you have in dealing with collection agencies. How often are the collection companies contacting you? If they're are acting inappropriate then you could have some leverage. Has some really helpful tips when hiring, and learning the rules which collection agencies have to operate under. These rules are called the Fair Debt Collection Practices Act and outline the rights consumers have. Especially when it comes to recontacting you or the way they go about contacting you.
