I receive a call from barrett smith associates about a debt i just want to no if they are a real company before a pay them.


I did a basic search and found a company in Lawrenceville, GA, number is 877-893-5966. If this is the company, I cannot tell you much, except for two things that stand out at me from their website. First, the website is copyrighted 2011, so it's a new site. Second, that the format they use isnt what I would really expect from a professional law office. Let me show you an example:

Highlighted in red for emphasis. I have known attorneys in different fields, and I cannot recall a single one of them that would put a website on the web that looked like this. At the bottom of the page, it shows that the website was designed by godaddy, with a clickable link for "cheap websites". The whole thing just feels cheap to me. I mean, I use godaddy for my own company website, but our business is just my wife and myself, it isnt a professional law firm. And besides, my website doesnt look half as cheap and cheesy as theirs.

OK, now I did a google search on "barrett smith associates complaint". Try it, it will show you plenty about these people. They are con-artists. Did they call and threaten you with court or jail? Or did they claim that they were "giving you a courtesy call" and that you were scheduled to be served a summons? These guys lie through their teeth. If you owe a loan somewhere, you need to contact that original creditor and see if they still own the note, because I wouldnt want to deal with people like this. Note this--if you get a letter like this, save it because it is evidence of their wrongdoing. Look at the letter--see where they demanded payment "no later than 30 days from receipt of this letter"? This was an initial contact letter, and that is called "overshadowing". It is illegal.

If they called you and said "I am coming to your house or your work", or "you could go to jail", or "I am going to serve you, but this is a courtesy call" then they are breaking the law and you should NOT pay these clowns one penny. Send them a certified letter demanding that they properly validate the debt.

Also, what state do you live in? These people have been contacting people from all over the country, yet they are in Georgia. I highly doubt that they are licensed to practice law in all these other states. Let us know what state you live in and we can help put some of the pieces together.

I'm calling from n.y. also they fax me a letter with the payments agreement that i made but the letter looks like something i can make up on my home computer. When i call them back to let them no i did a internet search on them he got kind of angry. And when i told him i talk to the company directly he wanted to do a 3 way call and find out way the company told me not to pay... Also they call on of my friends to tell them about the debt.. and someone did call me and said i will be serve at home or work

OK, thats another violation of federal law--they called your friend and told your friend that you owe a debt. ILLEGAL. That is called third party disclosure and it is very illegal. The next time you talk to these people, simply let them know that you have proof that they have violated the FDCPA in several ways, and that they are not to contact you again. Call the original creditor and speak with them--make sure it is even a loan that you owe, and if it is, make arrangements with them to work with them directly. If they say they cannot work with you, that you need to deal with the debt collector, inform them that the debt collector is majorly violating your rights and federal law, and if you need to, you will file a suit of your own against that debt collector. If they are willing to work with you directly, send a certified letter to Barrett Smith telling them to cease all contact immediately. At this point, you do also have the option of filing suit against them because they most definitely have broken the law.

Barrett Smith is over the top with FDCPA violations. Hopefully you've been documenting everything you posted here (including dates, etc.), and you will continue to do so with every other effort they make to contact you.

You can proceed as you wish, but I would definitely request validation of this debt, and if they continue to contact you after you request this information (and they have not yet produced it), please know this is an additional violation. That being said, they've already given you enough for which you can go after them, and I would. Again, it's your decision, but when collectors disclose information to third parties, it puts me over the edge.

i do know somebody who has dealt with these yahoos,and they are contacting attorney's in the area to sue this place.btw check into if your state is one party,or two party in regards to recording calls.the more evidence the better,but i do agree with skydiver and marie.a bottomfeeder that needs to be sued.look into it,compile the evidence,and go for it.
