need advice Please help medical bill & CA

hello wednesday i was called by a collection agency about a hospital bill for $11,700 from 2005.in 2010 i received a letter stating i owed this money so when i contactd the agency originally in 2010 i was told what the bill was for.I was under the impresion emergency medicaid paid the bill because when i was in the hospital i applied for it and was told by the social worker i would get it based on my salary at the time. well turns out i didnt get it and 5 yrs later i owe $11,700. 2010 was a bad yr for me and this thing just was pushed to the side to be honest. well i called the hospital and asked to make a plan of $125 a month and the woman was supposed to get back to me and friday 8/6/11 i received a call from the collection agency stating the hospital turned down my payment plan request and the manager of the dept fowarded my account back to the CA.
The woman on the phone was very nasty and when i explained the situation she didnt want to hear it. she said she will take $300 mo i said No i cant pay that can we work on something lower and she said i might be able to get you $250
I askedif it was possibleto bring the total bill lower since the CA dint buy the account for full price and she said sure but u must pay it off in full. so as the call was wrapping up she said what will it be we take you to court or you pay I asked for a few days to think about what to do and she said you have until monday and if i dont hear from you its going to court.
My father called the hospital and a woman said to pay $125 mo for 94 payments. i dont knkow why when i called they rejected my plan but when my father pretented to be me the lady said ok.Im going to the hospital tomorrow with my first payment so i get that first one in before monday.
My questions are
1. on monday i have to call this nasty bitch back and inform her im paying the hospital what should i say?
2. if i tell her im paying the hospital $125 can she call the hospital and screw this up for me since in her notes the recovery dept manager at the hospital said not to accept the 125 per mo plan and a woman my father spoke to on our 2nd call said i could pay $125.? she said to put my account number along with " in care of" her name.
3.if im paying the hospital directly can the CA still send it to court or try something against me?

ok i have a dv that i will be sending out this week,now my question is if they do Validate the debt then what? this will only be dragged out for maybe a month. if i send a letter out lets say friday and receive validation in a week or 2 then we r only in the first week of sept. i pretty much have my back to the wall here. i have until the 30th to make payment to the hospital of $125 per mo. the CA doesnt want me paying the hospital which is why they did this. im just at a loss right now, confused with all this.

i dont think the hospital did to be honest. i spoke to a woman at the hospital in e arly aug and she said make a payment of blah blah blah. i said ok when the CA called my parents house they told her i made arrangements to pay the OC when i spoke to the CA lady she said i was told you are paying the OC i referred your account to an attorney . and now 2 weeks later i got this letter. so i dont know whats going on. Im going to give my families attorney a call tomorrow and ask him about this. but im at a loss right now.

I got some more info. Btw I sent the dv today. I had to call the hospital for my father and find out some info for him
Regarding a bill and the woman I spoke to was the woman who helped me originally and she remembered me. She asked how things went with the CA. I told her and she said that my account was charged off and assigned to NBI or NIB CA I forgot and that the current CA might have purchased it. She's not sure she said. She also said that when she told me to send $125 payments they would except them but the hospital has nothing to do with the account. The money would then be reported to the CA.? Then said there's nothing the hospital could do since it's from 2k5 that I should contact the attorney and work it out with him.
I did send the attorney the DV today . I cmrr'ed it and I'm going to wait for his response but if this account was sold to the new CA does that change anything ?

Not really. You're still entitled to DV. As you know, this is approaching SOL expiration which is likely why they're hurrying it along. Sending the DV will drag it out a bit. And, if what they send you isn't validation enough, you can drag it out further.

If they do validate the full amount owed, it sounds like they're willing to work out a payment arrangement so, either way, I think you'll be fine.

Is Montefiore Medical Center the original creditor (where you received treatment)?

It looks to me like what you've told us previously isn't accurate. From this letter, it appears the original creditor (MMC) still owns the debt and has obtained an attorney to collect the debt.

Did the attorney provide you with an itemized statement of charges as it states in the letter?

Did you receive treatment at the medical center?

Do the charges look legitimate to you?

If the answer to the above questions is "yes," then you need to contact the attorney and either set up payment arrangements or try to work out a settlement agreement.

The SOL isn't up until December and the stall hasn't worked so, you're going to have to pay this. If you can still afford the $125 monthly payment, you might want to ask to get that started.

Everything I've stated before is all I know.
In august I was contacted by a CA who said they wanted *$250per month for payments I said I couldn't afford that and they said they were going to forward my account to an attorney. I contacted the OC (mmc) and was told I could make $125 payments and to notify the CA I was making the payments.*
When the CA was notified of this she said my account is being transferred to an attorney.
I then was contacted by this attorney. When I contacted the OC about this attorney the REP I originally spoke to said the account was charged off and was given to a CA by the name of NBI and that the current CA might have received my account from them. The OC Rep also said that the reason she said I could pay the $125 was because the hospital wouldn't turn away money but the hospital has nothing to do with this account.*

So I DV'ed the attorney and received this letter and an itemized printout that looks like it was faxed to him. The hospital never said they had an attorney involved, the CA said they sending it to an attorney.*
This is all that I know. I'm confused about all of this aswell And have absolutely no idea what to do.
Should I call the OC back and ask them about this attorney?
The CA won't accept the $125 they want $250.

I received a letter from a lawyer stating that I'm a defendant in a lawsuit filed by the OC and they would represent me and listed a case number. I wnt to ecourt and the attorney from the hospital file a civil suit on sept 16 which was the final day to return the DV to him. I'm going to either call him
Monday or contact a lawyer here in my neighborhood to see if we can settle on something.
