Today I received a letter from Portfolio Recovery Associates saying that if they do not receive payment from me by August 13, they are going to sue me. The amount is $1,548.34. They also offered me payment plans of $258.06 a month for six months and $129.03 a month for 12 months. My hours at work have been cut and my summer job ends in two weeks. I am not sure when substitute teaching will start up for me again so finances are kind of bad right now. I am very scared about this lawsuit letter and am not sure what do to. Is it too late to request debt verification? Should I just pay the $129.03 and eat ramen noodles for a month? I do not want to go to court as I cannot afford a lawyer and I don't believe I would do a very good job at representing myself. I do owe the money as it is left over from a rough time in my life when I couldn't pay my bills and thought credit cards were a good idea.


DV as in debt validation,not verification.also search for portfolio recovery in the bar.you will get more insight into this JDB botomfeeder.because that is what they are.they never sue anybody,and even if they could they can't do it that fast.if they could sue by the 13th of this month they would have done it by now.this is a bottomfeeder that does as SOAPLADY stated use illegal scare tactics to get money on debts past the SOL for the debt,and state the person is in.send the DV letter certified mail return receipt asap.

I am in Pennsylvania and the statute of limitations is 4 years. I last made a payment on this debt in 2009 so it is still within the statute of limitations. I sent them an email saying I wanted debt validation and that I will be sending them a letter requesting this also. I'm just really nervous because I've read about them suing other people and they haven't given me much time to do anything.

hang on a second....

Is this the first contact you have had with Portfolio? If it is not, when did you first hear from them?

If this is the first contact, or the first contact has been less than 30 days ago, then you have them cold on a violation of the FDCPA. They are not allowed to demand that you pay or else they will take legal action without first allowing you the required 30 days to dispute the debt. Please get back to us on this ASAP....

PS--dont you just love how PRA's letterhead says "we're giving debt collection a good name"???:D
