HELP!!! BoA will work but have other bills in CA
Date: Sat, 08/20/2011 - 23:04
1. CA Systematic National Collections has debit card number and taking payments. only owe $345.00. Can't pay in full right now, how to stop that and get them to remove from Credit Report once I do pay it off.
2. BoA CC: balance of $9000.00 they will work with me if I come up with $ 860.00 by Sept 4th. They said they won't raise the interest rate nor would they close the card per their crisis center. Would like to pay this off and keep card open for emergencies. "Only" 90 days behind. Have name of who I spoke to and date and time.
3. Sears card: balance of $ 900.00. Haven't heard a word from them but I think they still have an overseas address for me. Would like to pay this and have it removed from credit report. How to proceed?
4. Medical bills totaling $1500.00. One will take payments no worries. One already in CA. I told them I am out of work, but keep getting phone calls. How do I find out who they are and verify the debt? The phone call is pre recorded and says" if you are so and so and stay on the line for x amount of time you are aknowledging you are so and so"...then they give you a 1-888 number to call or press 9 to talk to someone.
5. Current on vehicle loan and mortgage. Don't want to file for BK. I know my credit is going to take a huge ding but figure paying off BoA over time and staying current on the vehicle and mortgage has got to help the credit score in time.
Any advice?
Getting stuff removed from your credit report is just not going
Getting stuff removed from your credit report is just not going to happen. Especially with the big guys. They report and will report accurately so I wouldnt waste a lot of time there.
If BOFA wont budge on the payment, have you thought of deferring one mortgage and one car payment to free up some cash?
The accounts will not be removed from your credit report after t
The accounts will not be removed from your credit report after they are settled. The creditors will only update the account status. If you can negotiate a PFD with the creditors/collectors, then the items will be removed from your credit report. But PFD does not work these days.
Medical bills - You can send a DV letter in writing to the CA. Pay off the debt only after the validation of debt.
Any of the listings ??? missed payments and defaults cannot
Any of the listings ??? missed payments and defaults cannot be removed from your credit report as these are right information and is going to stay on your credit reports for 7 years (from the day when these were listed).
As for the CA Systematic National Collections, try to close down that account or put a freeze on that so that nobody can withdraw money from that account. As for the other cards, try to work out repayment plan with them. In addition try to accumulate some more money so that you can make the payments on these cards.
Thanks,

As has been stated, payment or non-payment of debt is immaterial
As has been stated, payment or non-payment of debt is immaterial to FICO scoring. FICO scores the derogs and delinquencies that occured along the way, and does not score how, or even if, debt is paid. Many attempt to offer payment as in incentive for the creditor/debt collector to also delete their prior reporting, but that is at their discretion. They dont have to accept such PFD offers, and it may in fact spur them to increase collection activities, particularly if they suspect that the debt is approaching expiration of your state SOL.
As for having a debt collector that you dont know how to communicate with, that is one of the purposes of FDCPA 809(a). A debt collector is required to send written notice to you within 5-days of any initial communication with you, which includes reporting to your CR, and advise you by way of formal collection (dunning) notice of your rights, and how to exercise them. Didnt they send you a collection notice?
If you cant find an address for them, you can get it from the CRA by way of a request under FCRA 609(a)(1).
