The key to avoiding this is to avoid a judgment. Be sure to file an answer so that a default judgment is not entered against you. After doing so, take it from there and attempt to negotiate a settlement with the law firm if you have access to funds to do so. Sounds like you acknowledge that this debt is yours, so it is my opinion that this is probably your best bet. The last thing you want is to have to look over your shoulder for the next several years, wondering if your bank account is being levied. Best of luck to you!

Marie, this is the last time I am going to say this with regards to your posts--STOP assuming that the person "acknowledges the debt" all the time. The person did not give us nearly enough info to assume something like that, and I am frankly way too tired of seeing you post this same exact thing over and over again in cases where no such admission has been posted. Was he an authorized user on a company account? Was his name used fraudulently by the company? Did the creditor/debt collector wrongly slap his name on the summons because they want their money and dont care where it comes from? Did the OP start a company and his name actually belongs on the account? We have no idea. And you have no right to assume such information. You especially have no business telling people all about how they should try to settle a debt without even knowing if they rightfully owe it or not.
Look--you need to learn the process here. It is really simple--
1--is the debt really yours?
2--how old is the debt---is it past the SOL?
3--if it is yours and the SOL is not expired, has the CA proven that they have the legal right to collect it?
Assuming at any step along the way is NOT how we do things on this forum. By now, I would have thought that you had learned this.
To the OP, how did your name get to be on this debt? Let's start with that and go from there. See that, Marie? We ASK QUESTIONS HERE....its called LEARNING about the circumstances. Try it next time.
