Your first step will be to contact the California Department of Corporations in order to find out whether or not all your payday lenders are licensed to operate in your state. If you find that they are legal and licensed to operate in your state, then you can contact a local debt relief company and take their help in consolidating or settling the debts. However, in case you find that they are not licensed to operate in your state, then you will be liable for paying only the principal balance to them in order to get rid of the debts.

# Phone - (866) 275-2677
If you find that the lenders are not licensed in your state, then you can get rid of the debts by paying them only the principal amount. If you have paid them more than the principal, then ask them for the refund. Close your bank account asap so that they can???t debit money from your account in future. Illegal lenders won???t be able to take any legal action against you. To know how to deal with illegal lenders, glance through the following link:

Read the laws....only one loan is permitted at a time and rollovers are NOT permitted.
CLOSE YOUR BANK ACCOUNT ASAP. They are operating illegally by allowing you to roll over the loans!!!!!

I am in the process of trying to open an new checking account. Im so desperate that Im thinking of closing my original account.
But heres the issue.. A couple of these loans dont actually roll over. I pay them and then get a new one right after. So technically they arent rolling over.

So, even if they say they can and will take legal action against you in their contract, they cant?
I read in CA laws that they can only charge you $15 for bounced check fee..does that mean they can not charge you additional fees. Meaning, if I close my account and they are unable to take the monies from my account, they can only charge me $15. Is this a one time fee? Is there additional fees they can charge me? So for a 255 loan, plus the 45 "finance charge" and the 15 fee. Is this all they can charge me?
I am freaked out to do this. Its not that I have no intention of paying them, I just cant afford to pay over 1200 a month in fees. I have a kid in college and 2 younger kids. This mistake is effecting them too.

Hi and Welcome!
Based on your list, I have dealt with several of these lenders myself. I can tell you for a fact that California Check Cashing and Advance America are legal, because I have also dealt with them. Cash Net is also legal.
I am assuming that your Cali Check Cashing loans were made out to you and your husband? The good news is that they were very reasonable in making payment arrangements in my case. Depending on how long ago you made your loans, your checks might be at their Corporate HQ in Oakland, which means you will have to call Collections there.
Advance America? Not so much. I was able to work with my store manager, but I was still getting the nastygrams from their Corporate as I was paying them off. I would work with your store in this case.
At any rate, you need to CLOSE YOUR BANK ACCOUNT!!! They will be runnning their checks thru continually, using various DBA's (doing business as names) until they get their cash. In the meantime, you're getting hit with more and more fees.

Have you gone through this process?
I have opened another checking account, but am still afraid of the repercussions of closing my original account and defaulting on these loans. My thought process is to pay one off every two weeks until they are all paid in full (after closing the account), but I'm afraid that once I close my account and their checks or ACH withdrawls are declined, that they will continue to add more and more fees. Also, neither myself or my husband can have these people call our jobs and harrass us or have them begin to garnish our wages. Both of us can seriously get into trouble at work.
I have called both, Calif Check Cashing and Cash Max and neither does repayment plans.
I am so stressed about how this is affecting my regular household bills but am scared because Im not so sure how this will all end up.
Has anyone gone through this process? How did everything work out? Please, please help. Will everything work out okay?

I have indeed gone thru it. I stayed with the same bank (has the cute stagecoach in their ads) and they were very nice about giving me a new account number.
Re Cali Check Cashing: did you call the store or collections in Oakland? I worked with the collectors in Oakland after I stopped their check and was able to pay it off in two pay periods.

No I called the store.
Okay, so I'm feeling a little better about closing my account. My husband and I both have to have our direct deposits changed to the new account. It may take a couple of pay periods but I really want to get started on getting this cleared up before christmas...
