Sick and Tired of Being Sick and Tired !!!
Date: Mon, 09/26/2011 - 15:11
I currently have 4 outstanding PDL's
1. CheckSmart (PDL from the pit of hell)....$867 store loan
2. Cash in a wink $520 - internet loan
3. Gentlebreeze (a.k.a LaPosta Tribal Lending) $433.14 internet
4. Cashnet USA $200 internet
I have been pleading with checksmart to work with me but they refuse. they just keep calling, and calling, and calling. When, I do speak with someone all they can say is just pay back the loan in full and reborrow a lesser amount...and on top of that, their story keeps changing. one said they would accept 2 payments of $400, another said they couldnt. Another said if I could pay the full amount they would waive the $67 and I would only pay back the original balance of $800.00. I am in the process of contacting cashwink, gentlebreeze, and cashnet..to ask if I can get on a payment plan. I am not sure if these three are even legal in my state, OHIO. I have come to a point where enough is enough!! I have been backed into this corner for a long time dealing with PDL's and It is time for me to stand up and take charge of MY finances.
Oh and by the way..I closed my checking account..so I can regain full control of my money!!
I am sure there are going to be tough days ahead of me until I get out of this mess, I got myself into...I totally accept the fact that it was my fault to begin with...I put myself in this hole....However, I promised myself and God that when he brings me out of this..NEVER AGAIN!!! Even, If I have to do without some other things and can only afford to peanut butter sandwhiches for the next few months..I will do that rather than keep giving these crooks my hard-earned money.
any suggestions on further action?? Please share

You've closed your account, that's step 1. CNU is usually pretty easy to work with. They will give you an extended payment plan if you ask for it. With CheckSmart, you may have to simply default and set up payment arrangements with collections.
The other 2 are not licensed to lend in OH. You should only repay the principal amount of the loan (e.g. you borrowed $300 and have paid a $90 rollover fee 3X so you only owe them the remaining $30), no fees or interest are payable. If you???ve overpaid, ask for a refund. Be sure to include ACH debit and Wage Assignment revocation language when you send your letter. Email is fine. Don't waste money on postage :)

You send the illegal / unlicensed lender letter to each PDL and also give a copy of each letter to your employer. You may also want to save an additional copy for your records or in case you need it for your old bank account.
You can find sample letters in the link I provided in my previous post.

Concerning cash in a wink, I'm dealing with them now. They are calling me about 6-7 times a day and also calling my references. They've been threatening me with nonvoluntary wage assignment and legal action for about 2 weeks now. I can't remember how many times I've sent the letter. Everytime they call I send it. Along with it I send the payday loan laws of Ohio. Internet payday lenders must have a location in the state of Ohio. CIAW does not. Even though they have a Delaware address on their website, their collection calls come from A-1 Premium Acceptance in Kansas City. I have filed complaints with not other the Ohio AG, but the Delaware and Missouri AGs. Below is the link to the payday loan laws in Ohio:

Thanks Scooter for the info. I don't recall giving cash in a wink any references when I applied. However, I will be in contact with them trying to make payment arrangements with them. We will see how this goes.
Gentle Breeze
Do not repay this organization. They are a Japanese owned corporation who uses the La Posta Band of Mission Indians address in Boulevard, CA. The were busted so many times under the previous D/B/A's they were using, they have partnered w/ La Posta to enjoy sovereign immunity from state law(s). Basically, The Japanese Mafia.

Thanks Armstrong for the suggestion. However, I feel obligated to pay back only what I borrowed. It's a matter of principle and doing what is right (that is how I was raised). However, If they are trying to add on extreme fees thats a different story.. :-)
