I live in PA and took out a payday Loan off of the internent from Cashnet USA. The amount of the loan was for 460 dollars all the way back in 2006. I unfortunately was going through some financial hardship at the time (twins were born) and was unable to pay the amount back. I switched banks for a completely seperate reason and moved and now I am getting contacted by them trying for check fraud saying that they will be taking me to court. I can avoid this by paying another 460 dollars but unfortunately I don't have this either and they are not willing to accept a payment plan of $50 a week due to the amount of time from when the loan was taken until now.

What I am basically trying to find out is what are my consequences and how can I go about handling this so I can avoid having to go to court for this.

Really looking for help here.


since the loan was from 2006.i can state that the loan was sold by cashnet.why?because check fraud is a crime and criminal action is prohibited in PA on this type of loan.furthermore,pa is non-garnishment and the place threatening you knows this.they need to try and scare you into paying.do not without something in writing from them.do not talk to them again until you get something in writing,and email doesn't count.bottomline all signs point to cashnet selling the debt and a bottomfeeder trying scare tactics to collect.demand something in writing and do not talk to them further.

Thanks. I appreciate your help. They said if I don't pay them they will turn over to the DA of my county. Any idea what happens then?

since the loan was from 2006 it is is past SOL.good catch ohiogal1.so again re-read what i originally posted.in fact get an address from this place to send an FOAD letter.
