I am asking this for my friend, she had a Bradley's card well over 10 years ago and they have been out of business for 10 years now and all of a sudden this company has gotten and order against her and trying to garnish her wages is that legal especially when the statue of limitations is long sinced passed? What can she do I told her to ask them for a debt validation letter and file complaints with the New Jersey Offie of Consumer Protection, FTC, BBB, and the NJ AG. Is there any other information I can give her to aid her in this because I believe its illegal.
Any suggesstions?:confused:
first things first
have your friend check with whatever court granted the garnishment.have them check to see if a suite was filed,and how it was served.if they were not properly served then they can file to vacate the judgement on account of improper service,but they need to find out what court granted that and how they were served if at all.then go from there.

yes check as
rules for service vary.so have then check the procedure.it might be a case of improper service,but best to be sure.

pressler and pressler have been discussed here before.they just have a way of sliming around the law just enough.i too hope marie that danettere's friend can prove some wrong doing.
