VIP DES, help!

My husband was attempting to get a payday loan in July and was turned down (thankfully) by all companies because he is a contractor. All of a sudden a few days later a deposit of $400.00 from a VIP DES appeared in our bank account. He never applied to to this company. After that payments of $150 were taken out on his paydays. They are STILL coming out. We have paid $1150.00 on a $400 loan we never applied or signed for. I am LIVID and don't know what to do next. I told my husband we need to close the account altogether. This company is robbing us blind. He is very hesitant to close this account as all our bills are auto-debited from it, I have a suspicion they continue to debit us for as long as we let them. Is there a way we can stop this without closing our bank account? Can we appeal to get some of our money back somehow?


Your husband should have returned the money as soon as the $400 was deposited on his bank account. If your husband has used the money, then he will be liable to pay it back. He will have to pay the interests and fees along with the principal amount. Find out if this company is legal in your state. If they are not legal, then your husband will only have to pay back the principal amount. Your husband can close the account or put a hard debit check on the account if the pdl company is making unauthorized withdrawals.

Yep???Nandy is right. You should check whether or not pdl company is licensed in your state. The following link may help you in this regard:
http://www.debtconsolidationcare.com/paydayloan/explain-pdls-laws.html .If they are not licensed, then you are required to pay them only the principal amount. Since you have paid them more than the principal, then ask them for the refund. You can request your bank manager to put a hard debit check on your bank account so that they can???t debit money from your account in future.

Yes, it was essential for your husband to return the money then and there. However, now, the best thing would be to close down the account and in addition so that you need to file complaints with the State Attorney General. Moreover, it is also important for you to find out if your state allows payday lending and if the company is at all a licensed one.

your husband needs to know that you are right.this illegal piece of dirt will debit forever.now getting that account closed,and setting up a new one not linked to the old one is gonna take him,and you going in person and seeing either the relationship manager,or the branch manager.either one and nobody else.this will take a little time,but it's worth it.now as far as getting some money back.don't even think about it until you stop their access to your money.if you don't they will just keep debiting.to close you need to close that account asap.

Let's not talk about "should haves." He didn't return the money so that point is moot.

I will tell you though that, many of the online lenders have fine print that includes language giving them permission to forward your information to affiliate lenders so, I'm guessing that's likely what happened here.

Regardless, you need to close the account. It's the only sure way to protect yourself.

Go open a new account and change over your billpay items and your direct deposits. Then close that account. Send the illegal lener letter and file your complaints (see the dealing with illegal / unlicensed lender link someone else provided above) and as for a refund of anything that has been debited above the $400.

I have to second what OhioGal said: Enough with the "should haves". Most of us are on this forum because should have done something differently. We live & learn-- so anyway-- Paul and the others are correct about closing your account. Its scary and its inconvenient but it is absolutely necessary or else these slimeballs are going to have their paws in it every payday. If they turn out to be legal in your state; then my advice is to still close your account & contact the company to make payment arrangements.
