One thing that make me think they are illegal is that wage assignments are VOLUNTARY, not involuntary. Send them an email ASAP
"Dear QUICK ASSHOLES
I hereby revoke any and all VOLUNTARY wage assignment I may have signed for account #________ effective immediately."
Give a copy of the email to your payroll department.
They're not legal in FL. They can't do an "involuntary" wage ass
They're not legal in FL. They can't do an "involuntary" wage assignment without a court order/judgment against you.
Close your checking account immediately and then send them an email stating you revoke ACH permission and any wage assignment you may have signed. Give a copy to both your employer and your bank.
You don't owe them anything else.
Cash in a Wink further developments
Ok so I told them I would not communicate over the phone anymore and I send the letter from this site revoking all wage assignments to them and to my payroll department. However I recieved a nasty call from thier collections department stating that they are taking this as refusal to pay. She said that they have already spoken with Stephanie from my payroll department and are going to go ahead and process the involuntary wage assignment if I do not call them back to work wtih them. All this was after I sent the letter in an email to them. What do I do now?
After posting this, the A-1 legal department for Cash in a Wink called my Mother. They left a message stating I am going to have involuntary Legal Action taken against me. I am pretty sure they are not allowed to disclose information like that, especially to a reference and especially over the answering machine. All this is after I sent the letter that is linked to on the how to deal with illegal lenders forum, stating to only contact me by email.
a couple of things
first i would check to make sure your payroll person didn't honor the wage assignment.i'm guessing they didn't because this slime wouldn't be calling others and leaving that on a machine.i would file an AG complaint against cash in a wink as they are illegal, and act like it as you are now aware.
