I need some help. This forum has been a wonderful assett to me and I know need some input. My husband received a call from his HR person where he works stating that Mrs. Jenkins had just called and told her that he would be served either today or tomorrow with a summons for something. My husband called her back and she proceeded to tell him that he had a court case of Nov. 2nd and gave him a docket number. She also told him that he would be served papers at his place of employment. He called me very MAD about this woman. I told him that if she called back to tell her that he needed a letter of debt validation, which he did and she told him that she did not do this. He then told her not to contact him at work anymore. Several minutes later, his HR person called back and stated that this lady had called back to let them know that my husband would be served. She stated that she was from "Capital" and that the original loan was from Loan Point. I am not denying that we do owe them money, but $4300 bucks is far from what we owe. Now it has got both of us in a panic. He doesn't need to be served at work. I am sure that this is just a bottom feeder. But, don't they have to send you a DVL when you request it???? and, she called his employer back even after he told her not to contact him at work..What can be done about this????HELP!!!!!!!!!!!!!!!!!!!:(:(

This is a scam. Your husband won't be served at work. Anyway, you can ask your husband to visit the county court website and check if any case has been registered against him. Ask him to check his credit report once. Yes, collectors are required to send a DV letter when they are requested for it.

I agree with Nandy. You can make a written request to them for a debt validation letter via certified mail with a return receipt request. If they don???t give any reply, then forward them a Cease and Desist letter. After that if they are still trying to contact with you, then file a complaint against them to the State Attorney General or FTC.

this is a piece of dirt that needs to be reported.loan point is an illegal online lender that is illegal in every state.this capital is a piece of dirt that broke the law hand over fist.they will never send a thing as scamming wormslime never do.first file a police report using any numbers you have and the name capital.then use the same info to file AG,AND FTC complaints.bottomline your husband won't be served and the witch broke the law.file the report and complaints.then ignore them, and tell your HR person to just hang up in her face as that is what she deserves.

This is exactly why we have the FDCPA - now use it, because this woman is out of control and needs to be stopped. Good luck!

They are just saying Capitol. The number that they are calling from is 1-877-912-1685... Her extension number is 107 and her name is Donna Jenkins. She refused to give him an address so I don't even know who to write to request a DVL... She did tell him that the original loan was with Loan Point. This is an old loan, that to be honest, we let slide after we got all of our PDL's taken care of. We don't have a problem working with Loan Point on a payment plan of some sort, because I understand we do owe the money..... but I will not just pay anyone........ i just hope that the heffer quits calling him at work... It really makes him look bad....Please contiue with the advice....Thanks.
