Not sure if this is enough to validate

I am writing this on behalf of my mother. She received a letter dated Sept. 28, 2011 from Northland Group Inc. stating she owes $2148.79 for a Capital One credit card. The collection letter also has the current credit as LVNV Funding LLC with the previous creditor as Capital One. The name listed for my mother is also the wrong name but somewhat similar: first name is wrong and last name is correct. I sent a validation letter for her requesting additional information as we live in the state of Texas. I have read the collection laws for Texas. She receives a letter today dated Oct. 26, 2011 from Resurgent Capital Services. This letter lists the same for current and previous creditor as the first letter fron Northland. The amount is different though. It has $2159.06.

In additional to validating the date, I asked for [FONT="Calibri"]the original date of default or non-payment of the debt, the date the account was transferred from the original creditor to the collection agency office, and the surety bond information for the state of Texas.[/FONT]


The letter revied today also includes the validation of debt. What was validated was the full account number of the credit card and the current owner is LVNV Funding LLC. The debt was sold by Capital One on or about Aug. 30, 2011 with a balance of $2498.81. As of the date of the letter, the balance was $2159.06.

I was on the phone when my mother called Capital One to inquire about this. After talking withCapital One, the credit card number associated with her social security number has long been settled. The credit card number in the letter and my mother's social security number do not match up. According to Capital One, this account does not belong to her.

Also, there are no collection agencies listed on my mother's credit reports. She has not received any collection letters for about 3 years now from anyone.

What should be the next step that we take to clear this up with the collection agency?

Send them a cease and desist letter....tell them that you have spoken to cap one and you had no debt sold. In effect, tell them to bug off.
