Indiana PDL Help Please
Date: Tue, 11/01/2011 - 08:09
I have 2 PDL's and live in Indiana. I have looked at the IN licenses site but am still confused if my PDL's are legal or not here.
I have a $450. loan from Ameriloan and have only paid $135.
Also from QLoot (DMA Financial - VIP Cash) [They have 3 diff names but is the same loan  it's $400. Have paid them nothing so far.
My trouble is I got into more trouble right after applying and had no funds going into my bank account. Next thing I knew I have over $900.00 owed for NSF to my bank for these 2 loans trying to collect, I don't know why I did not think to close my account (ughhh).
Ok so now I have funds and I can clear up my bank but I can't make PDL payment for another week or so. I desperately need quick advice on how to proceed with these 2 PDL's from this point since I do still owe them funds. Also should I close my bank account now and try to pay the PDL's another way?
Again thanks for any and all help.
Scared, Anxious and Desperate.

No reason to be scared.
Neither of those lenders is legal. First close your checking account. Then, ollow the advice in this thread to learn how to deal with illegal lenders. You will find sample letters and other useful information, shared experiences, etc. You should only repay the principal amount of the loan, no fees or interest are payable. Be sure to include ACH debit and Wage Assignment revocation language when you send your letter.

OK I will go to my bank first thing tomorrow to close the account. Do I need to also still ask the bank to stop the ACH's?
Sorry I am not great with comprehensive skills, so by reading so much on this site I think I have confused myself more than necessary. Legal type letters tend to really mix me up. (sigh)
Also do I need to email and postal mail the PDL's the letter, or just email and do I mail to the FTC and BBB right away or after they respond.
I am so very sorry I am sure these questions are answered here and I am just mixing myself up. Please forgive me for asking probably redundant or repeated questions. I been looking over your site on and off all day which probably confused me more.
Thanks again for patience and help.

Sorry one more question.
For the PDL QLoot I got the loan from online from site called QLoot - But a phone call regarding that loan was from DMA Financial yet my bank statement from that loan has the money coming out from VIP Cash. Which of these do I try to send the letter to or how do I find that info out?
Sorry again and Thanks

people file complaints with their AG,not the DFI.please stop it.now for the OP alot of illegals use more than one D/B/A so that is why there are three entities on this.further proof of their illegality.you did close the account right?

1. Send emails. No need to waste money on postage.
2. Email to the address on the website where you applied for the loan (Qloot). Don't worry about their DBAs.
3. Go to your bank on the same day you send the emails and close the account.
4. Give your banker a copy of each of the letters showing that you've revoked ACH authorization.
5. Make sure the account is CLOSED and can't be reopened with an ACH debit. If they can't promise you that, then have them put the account on a deposit only status so no debits can come out period!
P.S. Actually, you should also file complaints with your state's DFI.
They can't do anything. But they will respond to your complaint
They can't do anything. But they will respond to your complaint, in writing, telling you that the lender isn't licensed in the state.
It's just an extra piece of paper proving the illegality of the loan.

Because of work issues I just got my bank account cloaed up today. I explained the entire thing to them and they closed up my account completely and even where nice enough to forgo some of the NSF charges and told me I can re-open an account with them when I feel I am ready. They were most kind and understanding, and hinted that they had seen this type of thing before.
Now I am trying to do the letters but my mind is so foggy right now I can't seem to focus on it and am unsure how to actually do this. I am still a bit unsure what indiana law each are violating. I know the Ameriloan is violating the auto renew part. But that's all I really can understand, the rest I am confused on. I have a copy of the Ameriloan contract but not of the QLoot/DMA Financial/VIP Cash contract as they don't seem to even have an online place to check on your account like Ameriloan did.
I dunno can you all help me from here or not but I do thank you for the help you have already given.

The law they are violating is that they must be licensed to lend
The law they are violating is that they must be licensed to lend in your state. They aren't licensed, therefore the loan is invalid. That's all you need to tell them.
