hello everyone... new to the forum and just looking for advice.

It's been a really rough year for me, and I have now found myself in the online payday loan cycle. I feel as if i have no control and see no end. So i've been reading up on a few topics here.

Right now I have already put a freeze on my account and stopped my DD. My bank told me to come back to the branch with my paycheck. they will then being my account to a zero balance and close it.

I do have ever intention in paying back my loans, however it will take some time to get above water. My question is what can i be expecting for the next few weeks while i work on getting all the funds to start paying them all back?

any information to give me some hope would be great.

since none of these are legal in FL we need the following

1)amount borrowed from each lender
2)amount debited by each lender until you secured your account

subtract line two from line one.you see since these are illegal loans you only owe the principle, and anything debited they call "fees" gets deducted from that.example:

you borrow 300.00 from pepper cash.they debit 90.00 three times.you only owe 30.00 on the loan.please provide that further info.we can help further from there.

As paul said, you only owe the principal of the loan. You need to send all of these lenders the "illegal lender" letter you can find in the link below. On the same day (no exception to this), close your checking account.

ZIP19: Did you actually borrow $765 or is that with fees? Have you loaned from them before and repaid?

500 fast cash: you owe $50

red stone: you owe $260

one click cash: you owe $200

pepper cash: you owe $150

little loan shop: you owe $150

Here's the link for dealing with illegal lender.

Everyone thank you so all the information so far.

From ZIP19 it was 765 borrowed, that doesn't include any fees. I've borrowed from them many times in the past and have repaid every loan with them. Should I dig up the amounts borrowed from them and amounts paid back??

*****I pulled up as much as I could from my online banking****

Within the last 3 months I've borrowed 5,755 from ZIP19 and have paid back 6,766.90 leaving I've over paid them 1011.90
*******************************************************************************
Also my account should be froozen however, I am still waiting to see if nothing gets charged just to make sure. I have already opened a new account and cancelled my DD. I think this way I have all the control over where my funds go.

Just did that... they would owe me 249.90.

My next question is how soon should I send the revoke of wage assignment to them?? I noticed in the template it's worded in there. That wage assignment is what really has me worried. Also can the illegal lender letter be emailed??

once again thank you so much for all this information, things are starting to look better for me.

Also make sure to file complaints with the Florida Office of Finacial Regulation. Just to calm your nerves know this in FL all lenders must be licensed if they are not the loans they issue are considered unenforceable and uncollectable. This will help you with forcing the lenders to accept your terms on paying only the principle.

I'm starting to get all the information needed to send out the letter's to the lenders.

I am having trouble locating some of the argeements, for some of these lenders. So the question is what would I use as a reference for my account for those letters?

I've gone to their websites, and some just don't provide any links to my argeements.

Tomorrow I'll know 100% if my account is frozen since there are a few payments that should not go in. I will send the letters shortly after I confirm that.

I am using this link to look up the lenders... So far not one has showed up.

https://real.flofr.com/ConsumerServices/SearchLicensingRecords/Search.aspx

Is it safe to say they are not legal in FL??

I know it was already mentioned that they are not, I just don't want to fire off the letter and they toss something back at me.

I've gotten my 1st response. They offered a settlment. However didn't count the previous 2 payments I've made. This company isn't even in the US.

below is a copy..

Thank you for your email. Our reputation is important to us and, as such, we are willing to consider the circumstances surrounding your request. Having reviewed your complaint in detail, we would like to mention a few points of issue before commenting on a resolution.

Regarding your question of jurisdiction, in your signed loan agreement you acknowledged that we are a Costa Rica company that registers and operates under Costa Rica law which both parties have contractually agreed to abide by. As was specifically stated in your loan agreement, the loan was provided in accordance with the Laws that govern licensed lenders in Costa Rica and the loan was approved and funded in Costa Rica. As such, we do not maintain a location in the State of Florida and are not registered with or subject to any other state agencies.

Having stated the above, we understand that many people are experiencing difficult times. So, while we are not obligated to do so, and in full and final settlement of your grievance and any claims you may wish to assert against us, we will agree to a settlement of your principal balance ($500) to be completed in four payments of $125 each (11/25,12/9, 12/23, and 1/6/12). Agreeing to this settlement will freeze any interest or fee amounts currently outstanding.

To finalize this settlement option, please reply ?I AGREE? in the subject heading. You hereby voluntarily authorize us to initiate automatic debit entries to your Bank Account in accordance with this Agreement. Only upon receipt will settlement be made. Please be advised that your account may be sent to collections if an arrangement is not agreed upon.

since they are not even licensed in my state. Should I just reply that all they will get is the $150 that is owed since I've made 2 payments already? this ofcouse will be once all my other payments have been made and i've above water again.

tell them to take their insult of an offer and stick it.they are bound by your state laws.not that hole in the wall known as costa rica.so email a response that reflects that.you only owe this piece of pdl trash 150.00 and that's it.also that you will not be giving them any bank info and that you will pay the 150.00 when you are able.also let them know you are filing AG,and FTC complaints against them.

Just an update.

1 company will be closing my account as soon as the amount remaining is paid. (LLS)

A few have sent me their emails stating the laws of their state. So I asked them for their lic number to do business in FL and told them that only the remaining balance will be paid. Still waiting on their reply (500 fast cash, pepper cash).

Some haven't replied to me after a few attempts (oneclick cash and redstone).

Then zip19 stated that their loan is legal but under the laws in Europe. I told them that I do not reside in Europe and that in FL you HAVE to be licensed, and again requested a refund for the over payment. I haven't heard from them.

Thats all I've got for now, and again thank you to everyone for your advice.
