I got a call from a guy claiming to be a process server needing to bring me papers. I wa at work. He gave me the name of Huntington Medition in 1 (877) 823-1745. Called and spoke to James Reed. Said papers were for a case filed against me by Loan Point USA and Centurian Funding for $1040 for a PDL from 2008. Said if I didn't pay I'd go to court. I asked for proof o the amount an they said it was in the sealed docs being served to me. Told me to set up a payment plan for the balance. Gave them my Amscott card number I never use to secure the payment plan and they said if I had to change the plan the had the right to cancel the deal and I'd go to court... This seems so shady... I know I Gould have just told them to serve me then but I was at work being watched by my boss an I got flustered. What should I do now!? Is this even legal? Should I call and cancel the payment and call a lawyer? Help please!!!!


Call your credit card company and have them cancel that card immediately.

LoanPoint is illegal. They are not licensed to lend in the U.S. and you've probably paid well over the principal amount that you borrowed.

This is a tactic used by illegal lenders. No one will come to serve you. You will not be going to court. This is and ILLEGAL lender.

The card I gave them is from Amscott and there's nothing in there yet, I had till Tuesday before the first payment. They said because they had paperwork from my bank showing auth of ACH debits that it's fraud. I can't remember how much was paid to them back then as I had several at one time and they all took my acct $5000 negative. I'm in Florida so the laws seem screwy anyway... Should I call them back too or just not let the payment go through?

So it's a prepaid card?

I still think you should cancel it and get a new one. They'll keep trying to hit the account. If you ever do put money on the card to use it some time down the road, they could hit it and drain the account. It's unlikely bu there's a chance. Better to be safe.

No need to call them back. They'll call you when their payment doesn't go through and then you can inform them that they need to send you something in writing. They won't. Ignore their threats. And remind them that you know your rights regarding both the illegality of the original loan and the FDCPA, which they're breaking left and right.

LoanPointUsa are scum just file complaints with the Florida Office of Financial Regulation on both the lender and collections company. In FL there is nothing these companies can do to you thanks to FL law that states all payday lenders must be liscenesed in the state, if they are not the loans they issue are considered unenforceable and uncollectable.

Well, cancelled the card and the payment didnt go through. Got a call to voicemail again today from this Edward Barton character saying the "case" was resubmitted to his office (mind you he sounds like he is 16) and that I had until he contacted me in person at my job or home to contact Huntington (who before said they were jsut a mediation company) to settle this or I would be served papers. I have found old emails from Loan Point and I think I found the paperwork and bank statements from back then so I guess it is just a waiting game now? This is so frustrating!
