Hello all... so I think I have botched up this whole process I was working on with these PayDay lenders... I have had a loan out from Loan Point back in late 2008. I had several out at that point and all of the debiting to my account took it more than $5000 negative. Loan Point had tried to debit the account a bunch of times, the loan was for $200 plus fees, etc. Now they are saying that they are serving me with papers for fraud because they have signed documents stating that they could use ACH debits on my account (which has been closed now for 2 years) and had this Huntington mediation firm send out papers for me in my county. This guy called me on my cell while I was at work in a meeting and told me he needed to serve me papers but wouldnt say from whom. But he gave me the name and number for Huntington. I called htem (all the while getting dirty looks from my boss) adn talked ot 2 people, one of whom was a jackass and the other whom was actually nice, but they told me I could set up a payment plan or go to court. I gave them one of my prepaid cards for the payment plan because i really wasnt sure the details and they wouldnt give me anything... I know, very dumb on my part. The first payment is supposed to be tomorrow but they are now telling me I owe $1040 for this $200 loan... I cant remember how much they got out of the account back before it closed, I have paperwork somewhere from the bank statements, btu I do know that BOA covered at least $1000 of ACH's before they started just adding fees to my account... Im not sure what to do here, should I make the payment to cover the original cost of the loan even though I think they may have debited more than $200 already or should I cancel the payments and let them serve me papers?

Help please ... any info would be great...

huntingto mediation is completely illegal bottomfeeder.so is loanpoint.cancel whatever payment as you should not have paid them a dime as they broke the law.try to get back the 200.00.claim the debits unauthorized.then ignore this piece of garbage.also if anyone uses the following verbage,or says the following.

1)they are a process server
2)you commited fraud
3)they are going to garnish just by a phone call
4)they are anybody, but who they really are.debt collection pondslime.

if any of those come up.tell them you are reporting them, and that you will not speak to them again until you get something in writing.to address your last point.this piece of dirt is not going to serve you anything.unless they moonlight at mickey d's and they ask.you want fries with that?

the piece of SH*T broke the law and lied out of their a$$ to get you to set up the arrangement.if there is nothing in writing they basically scammed you.nuff said.also since the loan was for 200.00 anything debited in fees before default gets deducted from that.now again that being said.see my post above.do not talk to anyone who uses or threatens any of those i mentioned already.you are not obligated to listen to illegal threats from trash.

Got a call yesterday from "James Shapiro" from a blocked number (looks like he blocked his own number cuz it was all 00000000) that said this was my last chance to call the "firm" to find out what is going on before he has to serve me papers for the fraud case that has been filed against me. Gave me the "firms" number, 1-877-720-4624 and said that if they dont hear from the "firm" that there has been a resolution his "agency" will have to go through with serving the papers...

this is nuts... Should I send a validation letter to Huntington? I have already sent one to Loan Point in the past that was returned "unaccepted". So, I am not sure what to do now...

why bother sending a DV letter?the loan was illegal in the first place and there might be some conjecture as if that addres is for this bottomfeeder.they could again be using that name only.file police reports against them.also AG,and FTC complaints.do not talk to them at all.they can't validate an illegal debt that btw you overpaid!
