I keep receiving calls from Portfolio Recovery Associates from different numbers; all day long, even on the weekends and after 9 pm. I have yet to answer the phone calls. Before I do anything, as far as sending a DV letter, I wanted to check here first as to what I should do.
I checked my credit report today, and PRA is it for two Capital One credit cards I had in 2006.
The first Capital one card went into default on 10/2006. The balance was $1635, and they charged it off in the amount of $833.
The second Capital one card defaulted on 1/2006. The balance was $1309, and they charged it off in the amount of $794.
I know it was my responsibility to pay them, and I did not. But I'm here for advice on Portfolio Recovery Associates, and how they bought this debt and are on my credit report for the full amounts of both cards. Also, I'm concerned because I believe (correct me if I'm wrong) the SOL in Ohio is 6 years. One card has been charged off 6 years this past October, and the other is about to be this coming January.
Is there anything in particular I should be doing? Do I just send them a DV and go from there? I just started receiving the phone calls the last couple of weeks, and just noticed this on my credit report today (it wasn't there last month).

The collection agencies can't call you after 9 PM. They have violated the FDCPA laws. If you want, you can file a complaint against them to FTC.
When was your last day of payment? Yes, you can send a validation letter in writing to them.

Thank you. Unfortunately I never made a payment to Capital One. I opened up both cards, one on 10/26/2005, and the other on 1/5/2006. The first one was closed on 08/15/06, and the second on 10/1/2006. I will send out the debt validation today to Portfolio Recovery.
They are now on my credit report. Supposedly they bought the debt on 7/2011, but I have never received anything in the mail. Can they go on my credit report without ever sending me anything?
