payday loan?

I took a loan with western sky and cash call is the company taking my payments out of my account. I live in the state of New York. I know that payday loans are illegal in my state, however I also read on this forum that Cashcall is run by a bank and not a payday lender. I have already paid more then the principal amount I borrowed. Is there anything I can do to get out of this loan.

Your loan ORIGINATED with Western Sky....it really doesnt matter who is collecting it now....the original loan is illegal. They will try to argue that since you made the loan on the web, their rules apply. They know as well as you do that only YOUR STATE laws prevail. Revoke any voluntary wage assignment you may have signed and give a copy to your payroll department. And STAY OFF THE PHONE!!

Hi,

Close your bank account immediately and then demand a refund as you don't owe them anything more than the principal amount. As the original lender is illegal, make sure you get back the extra money that you've paid them. They may call you to recuperate the money. Tell them the truth so that they know what's going to happen.
