Forsyth Law Office suing me

I just received a small claims summons to court in Jan 2012. Forysth Law Office is suing me on behalf of Norfolk Financial who is an assignee of Bank First. On the small claims paper it lists the Bank First account number and my last payment date of 10/3/2007.

Back in 2007 I fixed every single negative thing on my credit and to date I have scores of 700+. So, I asked Forsyth to provide me with info showing that this is a valid debt. I received a photo copy of my name with an account number and the debt amount. I then double checked with all of my credit reports (speaking to representatives) and verified that they have no information about Bank First, Norfolk Financial or the account number. They said they look as far as 10 years back.

Can someone please assist me in finding a way to make sure I don't have to pay this debt which is not mine? I am very confused and the Forsyth people are being asses.

since norfolk is an pdl lender.i need to ask you do one thing.check with your court clerk as they would have to sue you in your county,town,village,or bourough.also there should be a section where it gives you either 20-30 days to respond.there should be no date or month as a court date will not be assigned until that time.this smells to me.before panicking check that with your court clerk.it just raises alot of red flags.

Thank you both for posting. I live in mass. It is not out SOL based off the last payment they say was made which was 2007. I am being sued in the district court of the same city I live in. The county clerk has verified this info. I am so confused..... I dont understand how they can sue me if the credit bureaus dont even have a record of me having any Bank First account.....

you respond to your court clerk that you dispute this claim,and the fact a supposed payment was made in 2007.make them prove this.anyway respond to this asap.it is not always the case,but if said payment was made it would be on your CR right now.

Ty for the info. I am getting stuff together to send in with my dispute. In your first post you said Norfolk is a pdl lender. what does that mean? Also, can Norfolk apply interest to a purchased debt? I was reading that a lot of places cannot but still do it anyways.

norfolk does pdl's,but also buys junk/zombie debt.i am efforting to see if any of the three are licensed,or if this bank first was ever in MA.again this doesn't smell right at all and if you respond correctly it makes all the difference here.
