National Payday wants me to pay for their mistake and broken trust!

So I dealt with a payday loan with National Payday for $400, which was to be able to get my over until my next payday. As I have done PDLs in the past, I didn't expect something like what happened to my account to happen, as everything on the site told me that my information was secured.

However, that was when everything began to hit a slippery slope. I had another PDL out which I could pay up in full had this not occurred. A few days after I got the loan, I found out that my account was still in the red, and a week later, I found out that someone named Fund Assure (what it said on the Huntington online statement) three or four times as a verification of the account. Thing is, I got hit with several overdraft fees because of this. I had never interacted with Fund Assure before.

But this gets even MORE interesting. When I go to the bank to file a dispute about those four charges, I learn that my account was in the hole by MUCH more than what it said on my online statement. Apparently, the account was now in the hole by a staggering $100,000! I knew then that there was OBVIOUSLY someone just draining everything about the account. Thing is, none of this began until I dealt with National Payday.

Around Wednesday, I get this e-mail from NP, after a call saying to check my e-mail for the letter:

You are hereby notified that your electronic payment for check numbered 001, in the face amount of $50 issued by you on 11/4/2011 drawn upon Huntington and payable to NationalPayday.com has been dishonored.

You have 48 hours from receipt of this notice to render payment of such payment, plus a service charge of $25.00, the total amount due being $475.00.

If you are unable to pay the full amount within the time specified above, there is still a chance for a payment arrangement to be made. However, this cannot be done if you do not contact us immediately.

A payment is required at this time. If no payment is received you may be additionally liable for additional NSF or non-payment fees, reasonable attorney fees, incurred bank fees, and/or even third-party collection fees.

You will also be reported to a national database that every payday loan and cash advance company uses, stating that your account was in default. You will never be able to receive another cash advance from a lender that utilizes this database.

Additionally, you will also not be able to pay with a check at some of your favorite local retailers. If a retailer uses TeleCheck, TeleTrack, SCAN, or CheckAgain, then your personal check will not be accepted. Examples of retailers that use this system are Wal-Mart, Target, Sears, and many drugstores. Furthermore, if you use a check cashing service for your payroll check, this report will also hinder that ability.

Many states mandate that fees between $1,000 and $5,000 be assessed on such unpaid accounts. We can easily avoid this if you contact us to make an immediate payment arrangement.

If you would like to prevent legal action, you need to contact our office IMMEDIATELY to make payment arrangements toll free at 1-(877)-807-4827.

However, neither did it show that I was 100,000 bucks in the red, so there was utter confusion here.

I had filed the dispute about the unauthorized charges and was forced to open a new account and straighten everything out (read: make several trips to the local branch to transfer my funds to the new account), and I'm still waiting on the dispute to be resolved.

Also, I replied to "Priscilla" with the following:

Furthermore, Huntington has no record of any electronic check being returned. Only a returned check from someone who I did not have any prior contact with was shown (one of the many ways for me to tell my account was compromised). I had no prior issue of this kind until I dealt with your company.


Thus, if this continues to be a problem, I will be taking my own action. If I get harassed, as I have heard you are ready, willing, and able to do to other individuals, I will take even further action. Please consider this a cease and desist order from me. This is the only warning that your company will receive from me about this matter. I will contact the proper authorities if persistence is shown.

I had also filed a complaint with the BBB in Utah, saying that NP did NOT uphold their end of the contract, and I have serious suspicions that they are the reason why my account got severely compromised. They responded back saying that their Utah address was out of business. Of course, now they are exclusively in Costa Rica, and I provided the additional info. They probably already know this (as the page about NP on the BBB Utah site says, along with the F rating there), but it never hurts to try. I know there's another avenue I can take with this, but I don't know if I should wait on the BBB to look further into this or take this to an international overseer.

Part of my concern there is that yesterday I get another call. This one was from a woman that was hard to understand (foreign woman?), but was basically calling about legal action and such. I'm pretty sure ir was from NP. As it stands now, NP already has a cease and desist order from me, and they are STILL calling me. It's scaring me because these are the guys (the other PDL lender is based in America, so I would be able to understand them a LOT better if it was THEM, I would hope) that I suspect sent out my account info to people who should've never gotten it (unless it wasn't JUST them). The e-mail made me sick to my stomach. I threw up and had to call off of work the morning after from being so worried that something would happen to me because someone apparently stole my identity and/or account!

Thing is, the trust I had in NP was broken when I saw how much in the hole suddenly was (seriously, I was in the hole by 100k! How could I POSSIBLY pay someone who turned around and robbed me blind?). What are my options here? Should I be worried about this call (and e-mail) that I got! I live in Ohio, in case that helps!


they are posting that their account is negative by 100,000 which means there had to have close to that as no bank would let it get that far.so why did you need a pdl again and btw NP is not legal in any state.so while you do owe the principle only.if what you state is true don't pay them.

No, I didn't have that much (I WISH I did). It was just 100k in the hole, for some reason. The first time I learned of THAT aspect of it was when I was when I went to the local Huntington branch to dispute the Fund Assure charges. That was when I was floored with that surprise.

The dispute, by the way, was just won by me and I got the fees reversed. However, the fact remains that NP needs to be held accountable for what happened here, and I have yet to get anything further from the BBB on this. Who do I turn to if the BBB doesn't respond to my additional info on these people? How would I go filing this kind of complaint?
