Payday Loans in Indiana
Date: Wed, 11/23/2011 - 15:27
I got myself stuck in payday loans. I live in Indiana, here are the loans I currently have.
Plaingreen: Loan $800, $234.18 in interest
United Cash: Loan 500, paid 0 so far
Mycashnow: Loan 300, paid 0 so far
SureAdvance: Loan 700, paid $154
Online Advance: Loan 400, paid 0 so far.
What do I have to do next and what do I owe according to Indiana law. Where do I see if any of these lenders are legal in Indiana?
Also, I have had other loans with each of these companies and I believe I have overpaid on all of them. Can this help me in what I owe or do I just take those as a learning lesson since I paid all of them? Thanks everyone for your help.

At first you should contact the Indiana Department of Financial Institutions to know whether or not payday loan companies are licensed in Indiana. You will be responsible for the borrowed amount with interest and charges, if they are legal. For the illegal lenders, you will have to payback only the principal. Ask them for the extra amount since you have paid back more than the principal. Welcome tbrew,
Plain Green, United Cash and Sure Advance are illegal in Indiana. Find out if the other companies are illegal in your state from the Indiana Department of Financial Institutions.
Pay back only the principal amount on the illegal payday loans. If you have overpaid them, then ask for a refund.

Since most of the lenders are not licensed in Indiana, so you are liable to payback them only the borrowed amount. Ask them for the refund, if you have paid back more than the principal. You will be happy to know that illegal lenders won't be able to take any legal action against you. Have a look at this link: http://www.debtconsolidationcare.com/paydayloan/illegal-pdl-dealings.html

So I called Indiana Department of Financial Institutions. They told me that all of them were illegal. I received some news from the guy who spoke to me that I have not heard anywhere else. He said that if they solicited loan to me and gave me loan, that it was illegal and I was not responsible for principal or interest. He would not go into any further details, said he could not give me legal advice. I am not sure what is meant by solicited. He repeated it twice for me. Does anyone know where I can go to find out what is meant by solicited in this context? Thanks.
I have not paid the principal yet on these loans but have overpaid for previous loans. Do you ask them for refund since I have overpaid them previously? For example with Sure Advance
Loan 1: Principal 400 Paid 930
Loan 2: Principal 600 Paid 732
Loan 3: Principal 700 Paid 154 in interest so far.
Do I get a refund of overpaid amount - minus what is left for Loan 3. Or do I just pay back the $546 that is due on Loan 3. I'm a little bit confused about this idea. Thanks.

hey tbrew,
How have things gone with your pdl's? I also live in Indiana and have loans with MyCASHNOW, Online Advance, and United Cash. I'm ready to send my letters and have overpaid all of them.
Also, where did you send your letters for mycashnow? I can;t find an email for them?
Thanks!
