Hi again...
Ok, so I successfully worked out a payment schedule with some of the payday loan companies. So I have a little less stress than I had about a month ago. I seem to be having the most trouble with the legal payday lenders like Advance America etc. They want to do a payment schedule that I can't really afford, so I'm going to let a few accounts go into collections so I can work out lower monthly payments. I'm a bit worried because I've read that some collection agencies sue. When a debt is sold, do they give some time to work out a payment plan before court and or wage garnishment is brought onto the table? And what's this that these companies are telling me that they can collect for double the amount that I originally owed? I'm a bit confused.

It is true that the collection agencies can sue you. But they usually do that when they don't receive any payment for various months. They'll give you some time to work out a payment plan. However, some collectors are pretty aggressive. They may demand full payment within a certain date.

A collection agency has no legal capacity to sue. A collector cannot sue or even threaten to do so. Only a law office or attorney in your state can sue you.
