Hi,
I have a question. i have read some posts about closing the bank accounts accessed by payday lenders. where can i find the laws for closing my bank account in florida?

Hi Soaplady,

I need to pay my mortgage and the only way i can do this is if i close the account before another batch of payday loan fees hit.
because 2 bounce last paycheck the account is already in the negative, and i just can't afford for this to keep happening.

First with the bank account there are no specific laws on closing the account in FL so you should be able to just go into the bank and place a hard debit lock on the account to stop the payday lenders from attacking your account.

Second you will want to check to see if the lenders are legal in FL by going to the website for the Florida Office of Financial regulation. We can also be of help with this if you can list all your lenders, how much the loans were for and how much you have paid in fees and interest to each.

With this information we can better help you with getting out of payday loan hell that we have all gone through.

my paycheck hit my account today and after deducting the NSF fees on balance, and payday loan fees, i was left with $100 of a $950 paycheck. i felt so distraught.
the charges were listed as pending but the bank refused to stop payments or help whatsoever. at least i had the presence of mind to close the account.
anyway, I search the florida financial resources site and can't find where to go to find out if the lenders are legal in my state or not.
here is a list of some of my lenders
!. CMG Marketing - original loan $200 taken out in July, and paid every 2 weeks
2. United Cash - original $500
3. Cash in a Wink - original $300
4. One click cash - original $300
5. National Payday loans - original $200
6. Pluto Marketing - original $600
i'll find how much how much i've paid on the others so far and post it tomorrow.

I have checked for you and none of your lenders are legal in FL. What you will want to do is go to the sticky on how to deal with illegal lenders and use the template on that page for you letters. Remember to deduct any rollover fees payed from the principle that is owed, if they have removed more than the principle in rollover fees demand a refund from them. Once you have sent out the letters to each company file complaints against each lender with the FTC and the Florida Office of Financial Regulation. You can file a complaint with the FL AG if you like but they will just refer you to the Florida Office of Financial Regulation.

Each lender is going to try and tell you that they are legal and the FL law does not apply, but know this under FL law unlicensed payday lending is considered illegal making them unenforceable and unelectable.
