LVNV judgement but have no idea....

I was in the middle of a refinance so we pulled my credit and it came out fine then the loan was going through and they discovered a judgement agaisnt one of my homes for $9700.00 the name was misspelled and I've paid all my bills, and seeing how its not on my credit report i have to assume that they are going after the wrong person. how can i get this off my record?


SL, would they really have any standing to vacate a judgment if it isnt really theirs? wouldnt the true defendant be the only person who has any legal standing to do that?

anyway, in my experience you can have your mortgage co call the attorney for plaintiff and they will confirm that the judgment is not yours. try to get something in writing to that effect. similar situation happened to my father who's home was effected due to a judgment against me (im a jr).

Thank you for the quick answers!

So I did some research and found out that the judgement wasnt even me and the person it belonged to had been going to court.

What are my next steps? My brother is an attorney should I have him go to court for me to make a motion? Or have him call LVNV. Or just have my mortgage banker contact LVNV?

first thing youre going to want to do is confirm with the mortgage co what will satisfy their needs in clearing the title. if they just need verbal confirmation have them (or you with them in speaker and id'd as also on the call) call attorney for lvnv and confirm ssn doesnt match . if they need something in writing then might be best to have your brother call as your representation and request that.
