I have some pd loans, one from Ace Cash Express and the others listed below, what should I do going forward to stop these debits and what are the laws for Texas that I need to be aware of? I have contacted an assistance program for some help but want to see, I should close my Chase account and open a new one there or another back, send the ACH revoke form and make arrangements? I have not defaulted on any yet. If the fees are not correct than I have overpaid them already.
I would appreciate advise from anyone.
Seaside,Sandpoint Capital,Go Cash,Credix Loans, US Fast Cash, and Brighton Financial

Thanks :)

PDLs are legal in TX, as long as they're licensed.

Ace is legal. You should contact them and ask for an extended payment plan. Set up a payoff arrangement with them using a prepaid debit card if you can.

You're going to have to close your checking account because all your other lenders are illegal. Anything you've paid to them thus far can be subtracted from what you initially borrowed. You only have to pay principal. If you've overpaid, ask for a refund. If you still owe some money, set up a payoff in the same way I mentioned above for Ace.

You can also contact the Texas Office of Consumer Credit Commissioner for additional guidance at 800- 538-1579

Thank you for the information, I will do so, I have paid the principal plus more on these other companies. I will reach out to Ace also to plan arrangements as I have not defaulted yet. Should I explain to Chase that my account was compromised and I need to close the account? I saw on some post that people had trouble getting Chase to close their account. I appreciate your help. Since these companies are illegal and I have paid the principal plus more back to them at this point do I need to send them an ACH revokation form? I think I can find one on here, if you can direct me to one I would appreciate it.
Thanks

There's no form. Just send them an email explaining that you have been made aware that you have found out they are unlicensed/illegal in TX and that you revoke ACH authorization and any wage assignment you may have signed.

Give a copy of those emails to your bank and to your employer (HR/Payroll). Explain to your bank that you've overpaid the loan and they continue to debit your account. This is fraud and they need to treat it as such.

Also, when you email the illegals, ask for a refund of the over payments you've made.

I have a payday loan through Credix that I have paid $648.00 on a $400.00 loan.
I was told in a question I asked in a thred about Credix loans and I recieved this back from my question: "You're going to have to close your checking account because all your other lenders are illegal. Anything you've paid to them thus far can be subtracted from what you initially borrowed. You only have to pay principal. If you've overpaid, ask for a refund. If you still owe some money, set up a payoff in the same way I mentioned above for Ace"

Credix has now sent me this even though I have overpaid them.
"Credix Loans is responding to your correspondence regarding the above-captioned account. Based on your e-mail, we will no longer ACH debit your account and we have placed your work number on our no call list. Credix Loans, which is located in Texas, is a Credit Services Organization (CSO) that assists your lender in making loans. All such all loans are approved and funded in Texas, with repayment to be made in Texas. The loan agreement and website contain all disclosures required by Texas and make it clear that all transactions are governed by Texas law. On the advice of counsel, Credix Loans maintains that Texas law as controlling in the loan documents would be upheld, as all of the significant contacts in the loan transaction occur in Texas. The loan agreement is legal and enforceable. In responding to your correspondence, Credix Loans notes and reserves all available legal and equitable objections to the points you have raised and reserves all of its rights in this matter. Credix Loans provided this service as a convenience to you. We still consider your loan to be outstanding and are prepared to go to arbitration as provided for in the Loan Agreement between us. As an alternative, if you are experiencing financial hardship, we will be happy to speak to you about payment arrangements through which you can successfully meet your payment obligations. Credix Loans will consider doing so because of our continuing commitment to servicing our customers and not because of a legal obligation to do so. Should you have any further questions regarding this matter or if you wish to speak about payment arrangements, please contact us at 866-286-8683.

Now what do I do? HELP!!!

One in the West Indies agreed to consider this settled, two others insist they are licensed and I had them send me a copy of the contracts but my "electronic" signature is not in all of them. Is there a way to email them to you so they are not visible to everyone in the forum?
Thanks and I appreciate your help!

I read your post & my journey is about one week ahead of you as just closed my Chase account last week. Fortunately, all but 2 of my 6 PDL cleared the last paydate and not due until 1/31 so daily I would check until got my account positive; however, daily Chase was letting some checks go thru; charging me $132/day in fees and account over $1k negative!!!! I went in first and it was still negative and the branch manager was rude; refused to place a hardblock on my account and advised they would charge me NSF fees for 45 more days then the acct would close -- I asked then they would let it get over $4k negative, she applied that is MY fault and it was my choice to deal w/ these illegal companies and Chase would not get involved and would keep letting the amounts clear or charge a NSF!!! Finally, it went positive and I closed it.

I then (using the steps posted for handling illegal PDLs), I sent all my ACH revokation (?) letters and withdraw my wage assignment (though I am self-employed so they would have a little more of a problem; plus by our law here you are supposed to have a judgment filed before they can garnish you!)

USFast cash - no response to my letter (as see you also have them)...from the post it appears they may not respond at all. I have overpaid them over $2,000 so they may choose even more to ignore me.

Good luck and keep reading as I look at this website daily and learn something new everyday.
