Florida - AG & Office of Financial Regulation
Date: Tue, 02/07/2012 - 17:35
*typical timeframe for case to be started up?
*willing to work w/ you -- as see some post re: other states that the AG or Financial Regulation is unwilling to work w/ out of state (internet) PDLs and tells the borrower to contact another state & see other states (W. Va & others that fight for the PIFs and refunds)
*luck w/ getting refunds (I am owed btw $1,000 and $2,000 for each of these after I subtract what I borrowed from what I paid) - so am dealing with some serious money. {one actually is over $5,000 as two companies, same owner, so combined the complaint for them}
*Should I file complaints now too w/ the FTC? or let the AG and OFR start their work first.

What are the names of the pdl companies? Are your lenders licensed in Florida? How much did you borrowed from them? Give us clear information to get a right answer.

I can tell you this after working with both the FL AG and the FOFR I have found that FOFR is the one you want to work with because all the AG office going to do is direct you to the FOFR. As for the FTC I would go ahead and file your complaints with them now.
One thing the FOFR is not going to help you get refunds but they will make sure that each company understands they have no legal avenues to pursue you in the state of FL.

Refunds are going to be based on the lender and your own persistence. Most illegal lenders are offshore so, there's not much these agencies can do for you other than send cease and desist letters and hound them.

Thanks, & yes my main goal is for the PDLs to leave me alone, as some of mine I have heard horror stories about.
** 247 greenstreet/northway - overseas so would be happy if they would leave me & my employer alone as they already called to 'verify' my employment and try to send over a wage assignment - thankfully, my employer knew better & knows what a proper garnishment is & alerted me.
**Vista/Summit - they sent me a one line message stating collection #
and that was it (??)
**YourFastPayday - account still says in collections; however, they are not bothering me, but did claim on their one response the 'Indian immunity defense'
&
the best for last
**Ameriloan & USFastcash AKA AMG AKA Tribal Lending;Miami Nation - yes I have overpaid them by over $5k!! But I see not one person mentioning a refund on this site; On the positive side, I have found the owner's personal address through my own legal research/background so debating sending him CC: of all letters going out to all of these companies. I'm sure though I am not the 1st as appears the FTC is starting to seriously look into all of these companies!!!
So how hard should I push these co. listed for a refund?
Again, two refunds are about $1k each and the last is over $5k!
However, if the more I email/mail them makes them call me at home/work and bother my employer more, it would not be worth it.
Thoughts????
