I spoke to a Wells Fargo rep about putting a freeze on the ACH's hitting my account. The PDL companies are still trying this even after I sent them the letters. The bank is charging me $35 overdraft charges everytime, so now my account is showing almost $500 overdrawn. I can't close it because of this. Wells Fargo is saying that they can't put a stop to the ACH's because my contract with the PDL's supersedes anything else. I have opened a new account with a state employees credit union and now Wells Fargo is telling me that if they charge off the account that it will be reported and they will close my new account with the new bank because you can't have two bank accounts with one charged off. I don't know what to do....I have to have direct deposit with my job. I'm so afraid that this is going to cost me my job. I have been sending out the letters to the PDL's and have received two offers of settlement, but Plain Green won't even talk to me and I know that they are going to hit my account again tomorrow and send it into overdraft even more. What do I do?

You need to sit down with your branch manager and talk to them about Regulation E.

12 C.F.R. ?? 205.10 (c) Consumer's right to stop payment
(1) Notice. A consumer may stop payment of a preauthorized electronic fund transfer from the consumer's account by notifying the financial institution orally or in writing at least three business days before the scheduled date of the transfer.

They are required by law to honor your request to stop the transfer.
