phone threat to be served

I had several pay day loans around this time last year and started the process to get out of the hell I was in. I closed my checking account and went through all the proper steps with the letters and everything. I even got a refund from one of the illegal lenders. My question today is about a phone call I just received. It was from an unknown number and claimed that I was being summoned to court on fraudulent check charges( bad check) and that I would be summoned to court today and someone would come to my residence or employer today to serve me. The y didn’t give out any information about who they were calling for except to call this number (888-482-0096) and make a payment in order to not be summoned. I called back this number to see who they were and it said they were NCS.
I believe they are collecting on behalf of Cash in A wink. I have not heard from them in over a year until about 2 weeks ago. They started calling about 10 times a day. I simply ignored their calls. I live in Alabama and know they are illegal here and I paid well over the principal amount of the original loan. I am somewhat concerned about this unknown number calling me stating I am about to be served. Should I be concerned? Has anyone had a similar experience like this? What should I do?

Not to worry, they aren't going to serve you or summon you. Primarily because they can't. That's what legitimate attorneys do, which is something illegal lenders do not have. Oh, they'll say their attorneys will, of course. But an illegal lender CANNOT pursue charges against someone they gave an illegal loan to. Their hands are tied.
I've been there, done that, although not with the same letter.
Once my illegal lender sent my account to a collection agency, I forwarded the CA the letter I had from my state's Attorney General's office ordering them to cease and desist all collections activity (which the original lender refused to acknowledge).
Get in touch with your AG and the FTC, if you haven't already, and rest easy in the knowledge that there's nothing these buttwipes (mature, I know) can do to you except annoy you.

You state that this lender is illegal in your state and that you have already overpaid. Aside from the fact that you overpaid, if they are illegal, they don't have any real legal recourse against you. Also, a process server will not call you to try to get you to pay before coming over. Process servers generally work for companies independent of the original creditor and/or collection agency and are paid to serve papers to debtors to advise them of court dates or other legal action. Local authorities rarely get involved unless for some reason this company does actually have papers to serve you with and has the sheriff serve them.

Getting served is not the worst thing that can happen, in fact, in this situation (even though they most likely won't serve you) it may be to your benefit because you would have the opportunity to go to civil court and explain that this is an illegal lender, you have overpaid, etc, etc. In cases like this, I am more concerned about negative items ending up on my credit report so I would check that if I were you to see if there have been any new inquiries or accounts.

Also, there are apps that block calls so you might look into that. Hope this helps.

first file a police report as the jamoke broke the law.a few points.

1)check fraud is a crime and criminal action is prohibited on pdl's.

2)nobody can be served in one day.it is an illegal threat meant to scare you.

3)nobody calls ahead to tell you you will either served,or arrested.

btw yes more people than you know have been threatened like this.again file the police report.then do as the others advised and file AG,also FTC complaints against this loser as that is what he is.i guarantee you won't be served or anything else by this jamoke.report and ignore.

the loser broke the law with the call regardless.proceed as such.meaning file the police report and complaints against this bottomfeeder.

I received a call very similar to this today. However, the number to call back was 888-686-4918. Everything you stated in the original post was pretty much what the woman on my phone left on the message for me. I was scared, but after reading this thread, I am not anymore. I assumed it was for an old illegal online payday loan, but not 100% positive, as I am also behind on some other bills.

This company is a scam. I am a formal employee. So I know exactly wat type of phone y'all were receiving. The worker there would have to act like a process service for. What ever state they were callin the people. We would threating say yes u have a court summons to appear in court. The names that they would use when contacting these people were fake names. They told us we could not use our on name for our protection. Its nothin that they can do. The money thathh that collected from people didn't go to the people dat the loan was taken out on. It went in the ceo pockets, dats how they become rich. If I was u and u receive these call take it from me. Contact a attorney and let them hear the message. And hve the attorney to cll them, but what ever u do do not give them ur bank information wat so ever. Also becareful with the number that they give u this company changes their number every week it will never b the same number because they have people monitorin the internet to c if its any complains abt the number they r using. If so. They would come in and stop us from makin cll and give us a new number to give out. I was there only 2 months and realize somethin wasn't rite abt dis comany, within two months of me bein there they had change the numer att least 11 times. I would jst hang up and dnt answer if u ask me bcuz they r lyin to people and I feel as tho that not cool. Nowdays money is so hard to come by so u hve to very careful who u give ur bank info to.
