I have been trying to get my affairs in order after a rough patch. I have worked hard and made some headway on repairing my credit. There is still some outstanding debt that I am working on. So my questions are how common is getting a summons and judgement Is it going to come out of no where? Do they have to have someone actually serve you or do they just send it regular mail? I just don't want to one day wake up and have my bank account garnished or wages garnished without any forewarning.

You won't be garnished without a CA first winning a lawsuit against you.

Depending on your state, you will either be served in person or through the mail. If it's through the mail you'll generally get 2 letters, 1 via certified mail and a copy via regular mail.

Have you moved around a lot?

You can check your county court docket to see if anything has been filed against you.

Also, you generally get contacted multiple times by CAs and/or attorneys before a case is filed.

I haven't moved around a lot. I have been at my current address for 2 years before that I lived in same place for 13.

I am just worried after reading some of the posts that this could happen.

Do companies sue for small amounts. The highest debt I have is under 5000.00. And then there are a couple payday loans that I way over paid on since they were not licensed in my state, so I know I don't need to worry about those.

I guess my question is as stated above Do companies sue for small amounts?
