Hi Everyone,

I've posted threads on here about a year ago. The original threads were:

For the past months I've contacted some lawyers, and some have gave me decent guidance but lacked in confidence to sue the CA. Currently I'm waiting on one lawyer (Did NOT sign an agreement as of now) to determine to take my case or not. He is still reviewing my papers and documents. As a backup plan...well I contacted another lawyer just in case the other lawyer wants to bail.

The CA replied to my validation letter recently. It only took them 11 MONTHS to reply. Here's my big questions while I wait for the lawyers to decide...

1. The CA started communications via telephone by calling my cell phone and calling my parents house (I moved out 7 months ago). Is this activity legal?

2. How much "validation" is needed? As far as I'm concern...it's weak in my opinion.

3. Can I take any other steps to buy myself more time? I'm afraid they may summon me to court if I don't reply back to them soon.

Sure it is legal. Did you inform them that you had moved?
As for your cell phone, how would they know it was a cell? Did you tell them not to call that number because it was a cell?

Unless we know what they sent you, it would be hard to say.

1: No. At the time they didn't reply back to me what so ever. So I said "Why should I tell them that I relocated?" At least that's how I looked at it. My parents gave them my cell phone number in March of 2011. They stopped calling their number but called my cell number until I sent a VD letter. Now that they "validated" well they are calling both numbers again. I told my parents to save all messages they may have left and to tell the CA to stop calling their number because I no longer reside there.

2: They sent me a Bill of Sale And Assignment. I can barely read it. It's in horrible quality. They sent a Affidavit (Which is an employee or "witness" of the credit card company) which is notarized. The notary is legit. I looked into it. They also sent the last 4 months of my statements (Just the interest fees and late charges) from the original creditor, which was a credit card company. They also sent my Account Information Report. Now it sounds like a lot of "proof" but I don't see my signature on any of these documents saying that I "Accept or agreed to all terms/services etc". Also, they have the wrong person according to my license, birth cert. and SSI number. My birthday isn't the same info according to the Account Information Report.

3: That's all the info I can give at this moment, unless something else comes up.
