Being Harrassed by National Check Recovery Services

I called the number back because of course I was scared and startled. The automated system stated that the company was National Check Recovery Services. I was connected to a lady by the name of Diane at ext 111. She told me I had committed fraud because the payday loan I had taken out with paydayone.com was not able to be collected and that they had tried to contact me via email and I didnt respond. I remember taking a payday loan out with them in 2007 for $100.00. I dont remember if it was paid off or not, the account has long been closed. I am willing to pay the principle, to get them out of my hair, but they want my to pay $350.00, she said it was for accrued interest and fees. I was so shaken with by the voicemail, I set up a payment arrangement to come out on 2/29, from an account that is not funded and no debits will go through if the funds arent there. I live in Alabama and according to paydayone's.com website they dont even do business in Alabama. What recourse do i have at this point. I dont want them calling my phone nor do I want them to start calling my job.

paydayone.com is not licensed to do business in the State of Alabama, online or otherwise. You only need to pay back the principal amount that you had borrowed. You are not liable to pay any interest or fees related to the loan. Moreover, a collection agency cannot threaten you with criminal charges like check fraud as per the FDCPA. Send the collection agency a Cease & Desist Letter and file a complaint against them with the FTC.

don't pay them at all.report them using any info like their co name and number to your state AG.fact they broke the law in stating you commited a crime as that is what fraud is.fact chances are you don't owe this as since they are not legal in AL as sirius stated you only owe the principle.not only that,but if anything was debited that gets deducted from that so again chanes are you don't even owe this.the reason losers like this threaten like this is because of two reasons.
1)the loan was illegal and most likely paid
2)that being said they have to resort to "scare tactics"and over the top threats to get money as they have no legal way.
so report them to your AG,and your local police for the message as again the law was broken by them.

I recieved the same voicemail
I just got a voicemail saying I was gonna be served as well. Im in TN. It was national check recovery services as well and I did have an unpaid payday loan from 2009 for about $1000.
I called my local sherrifs office and they had no record of a court date or a summons on the date they said in the voicemail. I am judgement proof and not TOO worried but unsure of how to handle this. Im self employed and TN has a law that allows us to list up to $10,000 in exempt property and checking accounts so they can't get anything from me.
Was this just a scare tactic and if not how to do I proceed?

I received some calls from National Check Recovery Service a few weeks ago. It's a total scam. The first call is telling you a claim has been filed against your social securty number and you must call back with the case number. The second call is from a person (they change the name every few months) telling you that if he dosen't hear from you he will come to your house with legal papers to sign. The third call is him telling that he will be at your house at 2:pm and have your ID ready. He's not going to show up because he's hiding somewhere in upstate New York calling a list of phone numbers from a payday loan data base. They have a phony website that cost them $3.75 a month to try and convince you that they are a real company. DO NOT GIVE THEM ANY MONEY OR INFORMATION. DON'T RETURN THIRE CALLS - TOTAL SCAM!!!!!!!!

I had the pleasure (NOT) of dealing with these folks today. Here was my response:
Dear Ms. Bradshaw, Mr. Wilson, and all other parties at checkregistry.org and check-systems.com,
I received a call from a Mr. Allen Davis who claimed he had a "signed affidavit" for me to appear in court, and if I did not wish to be served, I should call 585-278-1316 and ask for Patrick Wilson regarding case no. 230884-VT.
I immediately called Mr. Wilson and was informed your organization was filing 3 charges against me including check fraud, and allegation of passing a bad check.
This was all apparently regarding a payday loan, said to have been originated by webpayday on August 10, 2008. You were seeking to collect $7,119.89 from me regarding this debt.
I stated that I did not recall a loan from webpayday but would need to consult my records and speak with my husband before accepting your "pre-litigation office's" settlement offer of $1,224.13. To my knowledge, I have paid all outstanding payday loans, but certainly would want to settle any legitimate debt still outstanding.
I have done my research, and determined the following:
1. According to my 2008 bank records, I never received a loan from "web payday."
2. My bank accounts were closed several months before August 2008, so it would not have been possible to receive a loan from them in August.
3. When I asked Mr. Wilson for proof of the debt, what was emailed to me (by Ms. Bradshaw) was the attached settlement letter. It does not offer any proof of the loan or its original amount.
4. If this is a legitimate outstanding account, I wish to rectify that. However, I will require a debt validation letter proving that the debt is mine, the name/date/amount of the original loan, how you arrived at the amount due, and that the lender is licensed in Vermont.
5. Please notice that I have attached a cease and desist letter. This will also be sent via certified mail. This applies to any future communication, excepting the debt validation letter requested above in item 4.
6. The settlement letter attached was drafted by a legal assistant for M. Robert Madia. Mr. Madia states that he no longer represents your organization as of November 2012.
7. According to their web calendar, my name does not appear on my county's court docket for the foreseeable future.
8. I cannot be charged with check fraud or allegation of passing a bad check, when I never actually wrote a paper check. It does not apply to ACH transactions.
9. Your organization has an F rating from the BBB of Western NY, and multiple complaints on debt-related websites.
10. And a tip as my gift to you: it is highly unlikely that a process server in VT and a collector in NY would have musak playing the same song at the same time.

They use scare tactics in trying to get money from you that has been collected already by stating they will be serving you legal documents at your home or place of business. My response to them is "Go ahead and serve me" They never have

I was contacted yesterday Linda Taylor with National Check Recovery; said they have information on payday loan from June 20, 2008 drawn on a Washington Mutual Bank; We don't have any of those banks near me nor have I ever heard of this bank. When I started asking questions about wanting copies of the docs etc she became rude and hung up on me; I called back; someone answered then hung up; i called back and got a voice mail of Tiffany Davis; i left my name and number and told her to call me back immediately; i called back again same # they called me on and Linda answered. I asked for her supervisor; she said she is the supervisor. I said no I want YOUR supervisor; she said they wont answer and if they do they will just transfer me back to her. I said I don't care put me through; I then got a woman named Katherine. They tell me they cant give me any information and did i want to settle it out of court or appear in court. I said I want to see copies of the documents; said i will have to get a defense atty and he will have to subpoena them. I have 27 year experience with working for attorneys and 1 year of working for a collection attorney. The original loan was $500 something and with now added fees it was like 900 something. Then the same night i had another guy call me from Triple AC who was very nice and he too had a payday loan; same company and same date of loan! only I owed $350 on this one; he gave me his name, direct #, website. I told him I didn't have the money now but call me back in June and I will see what I can do. I told the National check recovery people the address they had for me was old and I hadn't live there in several years. Offered to give them my new address so they can send me documents and they wouldn't take my new address!

The Guy said he was going to be in my county that afternoon and if i didn't call back within 2 hours he'd be at my house to serve me a summons to appear in court for a $200 outstanding PDL. He was ignorant and nasty..i said well seeing as you'll be in my area I'll put a pot of coffee on and we can hang out while he serves me..then he proceeds to say he can make these charges stick. I replied will that be now or within 2 hours when you claim to be showing up here in Michigan from new york ..you must travel fast lol. He got mad and hung up..these calls entertain me now because they're empty threats.

No wonder she got all mad about it when I asked her I wanted her to mail or email me the documents to confirm if it was me that got his loan her reply: you had till today to pay what is owed otherwise someone will be picking you up to arrest you 24-48 from now. good luck and happy 4th of july in jail and DON'T DROP THE SOAP BITCH! and hung-up on me! The same thing is happening with me right now but a part by the name of Diana Jackson is who is contacting me. She is saying this is stemming back from 2006 and that she has started filing the papers for he to be prosecuted to.the fullest extent of the law. I have filed a complaint with the Indiana state attorneys office and the local prosecutors office. She told me that my lawyer can't even save my a@@. And my bail will be set at 4500 hundred dollars. I had the sheriffs department call her and I think they scared her. Her number comes up as a cell number and there is no address for National Check Recovery in Nashville TN! So I went to.Verizon and had her number blocked!

If they are calling about a debt from 2006 (or even 2008 n many places) there is likely an issue with the Statute of Limitations. They can still try and collect, but if the SoL has run out, there is no way they can force you to pay in court or elsewhere. Just don't make ANY agreement because that can re-start the clock.
In any case, my answer is "go ahead and serve the papers, I'd love to share this story with a judge." I almost never hear from them a second time, and I have never had one actually serve papers.

I received a call from Jessica Stewart from National Check Recovery Services saying that the payday loan company is going to file criminal fraud charges against me if I do not come up with $500 right now and pay by credit card and that there is no way out of this situation. I asked for documentation first and she said that the payday loan company has sent out letters and THEY do not want to have anything to do with me. The only way I can stop this is to borrow money if I do not have it. She gave me 24hrs to call her back or she would have to turn my case over to the State of California..She said she was only an investigator and that she would transfer me to a processing department to take my credit card payment and then email me a receipt along with a letter exonerating me of all fraud charges..not sure what to do..HELP any suggestions?

I did research on the number she called in from and the number is registered to a P. Rogers. 214-217-9134. I told them I would like to see proof of this loan and all documentation, including the attorneys that will be prosecuting me and I have not heard anything as of today's date 9/17/13. They will NOT cooperate with me in anyway..I am still shaken and distraught over this!

Why are you still talking to them? They never make good on any of their threats anyway. Ignore them and when they find they're not getting any money from you, they'll move on to their next mark. Report them to your state Attorney General's office and the FTC.
