please help!

I am being threatened by a collection agency saying they are suing me for check fraud! When I tried to pay they said they would only take payments in the form of a card and those payments could only be drafted out at a future date by the company. Someone please help me, what do I do?


i don't care the identity of the bottomfeeding slime.they broke the law in threatening the person with a crime.as that what check fraud is.the OP needs to file a police report,and ignore.i will ask what number they have as i'm almost sure they got no real info on this piece of dirt.we can maybe find more info that way,but just report them to your police and ignore.debts are civil matters,and fraud is a crime.they broke the law bottomline.

I assume that this is for a PDL since you are in this forum. Go to the sticky post in this forum which outlines the PDL laws for each state. I believe there is also a link to lenders that are licensed. If your lender is not licensed in your state then you only need to pay back the principal and really are only morally obligated to do that much. If the lender is licensed then you do need to pay the interest they are charging. Legal lenders are much, much more willing to work with you. From the way that you described the call I assume that it's either a straight up scam or a call from an illegal lender.

A word about "check fraud", not paying on a PDL, whether illegal or legal, does not, in most states constitute check fraud. Unless you went on a shopping spree and wrote a hot check for $1,000 you have not committed check fraud.

If I were you, I would block the number and file a complaint with your AG's office if you do know what company this is. Good luck.
